Background: The 1996 Edition of the Standard Traffic Ordinance (STO) has been issued by the League of Kansas Municipalities. The proposed ordinance incorporates the STO by reference and sets out separately the City's amended versions of Section 33 regarding maximum speed limits (more detailed than STO) and Section 85 regarding stopping, standing, or parking (yellow painted curbs. ) Changes from the currently applicable 1994 STO include: Section 13 - Traffic-Control Signal Legend. Minor changes regarding the traffic control signal legend. Section 14 - Pedestrian-Control Signals. Adds reference to "walking person" and "upraised palm" as symbols for pedestrian control signals. Section 16 - Lane-Direction-Control Signals. Provides more specific detail concerning the meaning of the different colors of lane direction-control signals. Section 17 - Display of Unauthorized Signs, Signals or Markings. Augments sub-section (b) concerning prohibition of commercial advertising upon any traffic control device by adding "except for business signs included as part of official motorist service panels or roadside area information panels approved by the secretary of transportation." Section 31 - Fleeing or Attempting to Elude a Police Officer. Includes provision for use of a police bicycle as a pursuing vehicle. Section 33 - Maximum Speed Limits. The STO section was amended to reflect the increase in highway speed limits. The City's version addresses the same issue by allowing for posted speed limits in excess of 55 miles per hour. Adds provision that a driver shall yield the right-of-way to pedestrians within an adjacent crosswalk, and provides that if a driver is involved in a collision with a vehicle or pedestrian in an adjacent crosswalk after driving past a yield sign without stopping, the collision shall be deemed prima facie evidence of the driver's failure to yield the right-of-way. Section 69 - Pedestrians Soliciting Rides or Business. Adds provision that soliciting of contributions shall not be prohibited if such person or organization has first obtained a permit authorizing such soliciting from the city. Section 87 - Accessible Parking. Adds height requirement for signs designating accessible parking spaces installed on or after July 1, 1995. Minimum violation fee for parking in an accessible parking space unlawfully is increased from not less than $25, to not less than $50. Section 87a - Accessible Parking~ Revoked or Suspended Devices. Increases the fine for any person utilizing any accessible parking identification device which has expired or has been revoked or suspended, or who utilizes any accessible parking identification device issued to another person, an agency or a business, from "not to exceed $100," to "not less than $100 nor more than $300." Section l14a - Unlawful Operation of All-Terrain Vehicle. New section prohibits operation of all-terrain vehicle on any interstate highway, federal highway, or state highway, or within the corporate limits of a city of the first class; EXCEPT for those owned and operated by a county noxious weed department or persons contracting with a county noxious weed department or the Kansas Department of Transportation. Lights are required for operation on any public highway, street, or road between sunset and sunrise. Section 131 - Riding on Roadways and Bicycle Paths. Brings mopeds under the same section that addresses operation of bicycles at less than the normal speed of traffic. Section 192 - Driver's License. Provides for a fine of not more than $1,000 or imprisonment for not more than six months or both for driving without a valid driver's license. Section 198 - Vehicle License; Illegal Tag. Adds a provision calling for a fine of not less than $100, forfeiture of the vehicle, and a mandatory court appearance. Greg Bengtson BY: BY: Section 199 - Unlawful Use of License. Adds a phrase to specifically prohibit the display or possession of any canceled, revoked, suspended, fictitious or fraudulently altered driver's license for use in the purchase of any alcoholic liquor or cereal malt beverage and increases the fine from "not more than $1,000 or by imprisonment for not more than one year or by both." Staff review of Chapter 38 identified two sections no longer in use. Both relate to police department involvement in licensing persons under age 16 to drive. The City has no involvement in the licensing of drivers. The proposed ordinance simply repeals both actions. Recommendation: 1. Adopt Ordinance Number 96-9752. 2. Adopt Ordinance Number 96-9753.
