Resolution authorizing the Mayor to execute an agreement with
Saline County for the development, use and maintenance of a
parking lot to be located at the southeast corner of Park and
Tenth Streets.
Background
The city and county have been working towards the creation of a
joint parking lot to serve the employees and patrons of Memorial
Hall and the Law Enforcement Center. The property was acquired a
few months ago and the buildings have recently been removed. The
next step is to complete design plans and seek bids for
construction of the lot.
In order to proceed with the design and construction phase, it is
necessary to formalize the arrangement with the county on the
development, use and maintenance of the lot. An agreement setting
out the terms of the arrangement is attached.

PARKING LOT AGREEMENT
This Agreement is entered into this ~ day of , 1996, by and between
the CITY OF SALINA, KANSAS (the "City") and SALINE COUNTY, KANSAS (the
"County").
Recitals
A. The City and County wish to jointly develop and utilize a parking lot located on
the southeast corner of the intersection of North Tenth Street and Park Street (the "Parking
Lot").
B. The Parking Lot shall be located upon both real estate currently owned by the
City and real estate currently owned by the County. While the parties intend to design and
develop the Parking Lot as one, the City and County will retain separate ownership of their
respective tracts of real estate.
C. The City and County either have or will expend funds toward development of the
Parking Lot as outlined in the attached Exhibit A, and wish to allocate parking spaces based
upon their respective shares of the development costs, also as shown on Exhibit A.
D. In anticipation of a potential need for expansion of the Juvenile Detention Center
located immediately east of the Parking Lot, the County wishes to include in this Agreement a
means for its future use of its property for that purpose, while providing a means of either
replacing or compensating the City for any loss of its allocated parking spaces.
THE PARTIES therefore agree:
1. Parking Lot. The City and County agree to develop, utilize, and maintain the
Parking Lot pursuant to the terms of this Agreement. Exhibit A accurately reflects the
respective amounts contributed toward development of the Parking Lot and the resulting
allocation of parking spaces. The allocation of specific parking spaces within the Parking Lot
shall be by agreement between the city manager and the county administrator, or their designees.
2. Demolition and Construction. Each party shall be responsible for demolition of
any structures located upon their respective tracts of real estate. The City agrees to design, bid,
manage, and inspect the construction of the Parking Lot.
3. Maintenance. Maintenance of the Parking Lot shall be administered by
agreement between the city manager and the county administrator, or their designees. The cost
of any specific maintenance project shall be allocated between the City and the County in the
same ratio as the allocation of parking spaces at the time the maintenance work is performed.
4. Potential Expansion of Detention Center. If the County later finds it necessary to
utilize part or all of its tract of real estate covered by this Agreement for expansion of the
Juvenile Detention Center, it may do so upon the conditions that it provide the City no less than
120 days written notice and that it either:
(a) provide the City with an acceptable off-street replacement parking space
within 250 feet of either Memorial Hall or the Law Enforcement Center for each of its
lost parking spaces; or
(b) compensate the City the principal sum of $5,250, plus annually
compounding interest at the rate of 3% per annum from. the date of this Agreement, for
each of its lost parking spaces.
5. Term. This Agreement shall remain in full force and effect until mutually
amended or terminated by the parties.
