WITNESSETH: The Grantor for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, does hereby grant, bargain, sell and convey unto the City, a temporary construction easement in, through, over, and across a certain portion of land owned by the Grantor, as legally described on the attached and incorporated Exhibit A and as depicted as TRACTS 2 and 4 on the attached and incorporated Exhibit B (the "Temporary Easement") for all rights of ingress and egress of the City, its employees, contractors, and franchises, for the purposes of access, storage of materials and equipment, and surface reshaping or regarding, for a term expiring on December 31 ,2006. Expires 0 () EXHIBIT A TRACT 2 Temporary Construction Easement in South Industrial Area #3 A strip of land 20 feet wide, on the North side of the following described survey line in Lot 1, Block 1, South Industrial Area #3 In the City of Salina, Saline County, Kansas: Commencing at the Southwest comer of said Lot 1, Block 1, South Industrial Area #3; thence North on an assumed bearing ofNOooI5'37"W along the West line of said South Industrial Area #3 for a distance of 382.87 feet to a point 15 feet North of the North line of the South Half of said Lot 1; thence N89058'39"E along a line 15 feet North of and parallel with the North line of the South Half of said Lot 1 for a distance of 30.00 feet to the Point of Beginning, said point being on the East line of an existing 30 foot Utility Easement; thence N89058'39"E along a line 15 feet North of and parallel with the North line of the South Half of said Lot 1 for a distance of 1063.90 feet to a point on the West line of an existing 90 foot Utility and Drainage Easement.
