GRANT OF TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE. made this Y >i day of ~~ . 2006 by Salina
Economic Development Corporation, (the "Grantor"); and the ITY OF SALINA, KANSAS a
municipal corporation (the "City").
WITNESSETH: The Grantor for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, does hereby grant, bargain, sell and convey
unto the City, a temporary construction easement in, through, over, and across a certain
portion of land owned by the Grantor, as legally described on the attached and incorporated
Exhibit A and as depicted as TRACTS 2 and 4 on the attached and incorporated Exhibit B
(the "Temporary Easement") for all rights of ingress and egress of the City, its employees,
contractors, and franchises, for the purposes of access, storage of materials and equipment,
and surface reshaping or regarding, for a term expiring on December 31 ,2006.
IN WITNESS WHEREOF, the Grantor has signed this Temporary Construction
Easement the day and year first above written.

TRACT 2
Temporary Construction Easement in South Industrial Area #3
A strip of land 20 feet wide, on the North side of the following described survey line in
Lot 1, Block 1, South Industrial Area #3 In the City of Salina, Saline County, Kansas:
Commencing at the Southwest comer of said Lot 1, Block 1, South Industrial Area #3;
thence North on an assumed bearing ofNOooI5'37"W along the West line of said South
Industrial Area #3 for a distance of 382.87 feet to a point 15 feet North of the North line
of the South Half of said Lot 1; thence N89058'39"E along a line 15 feet North of and
parallel with the North line of the South Half of said Lot 1 for a distance of 30.00 feet to
the Point of Beginning, said point being on the East line of an existing 30 foot Utility
Easement; thence N89058'39"E along a line 15 feet North of and parallel with the North
line of the South Half of said Lot 1 for a distance of 1063.90 feet to a point on the West
line of an existing 90 foot Utility and Drainage Easement.
The above described strip of land contains 21,278 square feet or 0.488 acres more or less.

Temporary Construction Easement
A strip of land 20 feet wide, 10 feet on each side of the following described centerline,
lying in the West Half of the Southeast Quarter of Section 1, Township 15 South Range 3
West, In the City of Salina, Saline County, Kansas:
Commencing at the Northwest comer of the East Half of said Southeast Quarter; thence
West on an assumed bearing of S89056'23"W along the North line of said Southeast
Quarter for a distance of 10.00 feet to the Point of Beginning; thence S00005'00"E along
a line 10 feet West of and parallel with the East line of the West Half of the Southeast
Quarter of said Section 1, for a distance of 1201.29 feet to a point on the North line of
South Industrial Area #3 and 10.00 feet West of the Northeast comer thereof.
The above described tract contains 24,026 square feet or 0.552 acres more or less.
