Administrative Brief . COMMISSION INFORMATIONAL ~ffiMORANDUM August 3, 1979 VOL. I, NO. 11 ITEMS OF INTEREST 1. Larry Bengtson feels that the City could eliminate primary elec- tions by charter ordinance, because K.S.A. 25-2108a was not appli- cable uniformily to all cities. According to the July, 1979 Kansas Government Journal, the City of Chetopa, Kansas, just abolished primary elections by charter ordi- nance. The City of Columbus, Kansas, abolished primary elections by charter ordinance in August of 1973. The School the City. to charter prefers to Board #305 holds a primary election on Unlike the City, the School Board does out from under K.S.A. 25-2108a. Also, retain the primary election. the same day as not have authority the School Board Salina did not have a primary in 1979 because there were only two candidates for each office. However in 1977, the City held a pri- mary and the cost to the City was $3,521.68. 2. It appears several City departments consider the special needs of the physically handicapped. Sunset Park has a drinking fountain for the handicapped. Two bath- rooms have just been ordered for Ivey Park which will accommodate those who are physically handicapped. Plans call for the construc- tion of a special water fountain in Ivey, curbcuts at Ivey, and special park tables in all the City parks. In the future, several parking spaces at Ivey will be designated specifically for the handicapped. The Park Department is developing a cost estimate for making all park bathrooms accessible to the physically handi- capped. The Street Department has installed three parking signs at the Bi- centennial Center, two at the Community Theatre, one at Carver, and one at Friendship Center. Both Carver Center and Friendship Center are accessible to the handicapped. Both have ramps and signs. At this month's Building Authority meeting, Curt Wood will present several proposals: a. Recommend special parking signs in the City parking lot as well as in the Library parking area. b. Propose the removal of the bench in the City Commission Room closest to the door. c. Request the installation of hand railings in the City-County restrooms, and the widening of the stalls to 3'6". CIM - August 3, 1979 Page Two These proposals will help meet some of the special needs of the physically handicapped without undue expense. R.S.A. 58-1301 states that all public facilities or buildings constructed after January 1, 1979 must meet the American National Standards Institute specifications for making buildings and facil- ities accessible to, and usable by, the physically handicapped. The statute is not retroactive. 3. For several weeks now, Curt Wood has been researching the subject of noise control and abatement. He contacted John Rupf of the En- vironmental Protection Agency. Mr. Rupf will come to Salina and discuss with the City Manager and staff any issues relating to noise control and abatement. He is prepared to offer technical assistance relating to the substantive make-up of noise ordinances, noise measurement, requisition of equipment, etc., and is also willing to set up workshops for enforcemen~ personnel once a noise ordinance goes into effect. Your thoughts? 4. The four tracts of land located at 1330 W. Ash, 209 N. Broadway, 1420 N. Ninth Street, and 1510 N. Ninth Street will be sold by sealed bids. Sale was authorized by the Commission on May 21, 1979. Sealed bids will be received by the City Clerk at 10:00 A.M. Au- gust 16. City Commission action is scheduled for the August 20 meeting. The County Assessor will appraise the four tracts. That appraisal will serve as the basis by which bids will be accepted or rejected. 5. A temporary restraining order prohibiting the director of accounts and reports from requiring all "political subdivisions of the state to reduce their proposed mill levies or dollar budgeted amounts by the amount of projected funds available from the local ad valorem tax reduction fund (LAVTRF)" was issued today by Shawnee County District Court. At the same time, Attorney General Robert T. Stephan told a news conference that, because of the enormous legal ramifications, the question of handling local ad valorem tax reduction funds "should not hinge upon a mere legal opinion but should be answered with finality by a judicial determination of the issue." The net result of these two actions is that cities and counties may proceed to publish their budgets just as they have in the past. It'is not necessary at this time to reduce the proposed tax levy by the amount of LAVTRF. The suit in Shawnee County District Court, filed by Sedgwick County District Attorney Vern Miller on behalf of the Sedgwick County Board of Commissioners requests a declaratory judgment on the issue. Attor- neys on both sides of the issue have until August 10, 1979 to file briefs in the case. The request for a declaratory judgment will be heard by the court on August 16, 1979. CIM - August 3, 1979 Page Three This doesn't mean the issue is resolved. Should the court later agree that LAVTRF should be used to further reduce taxes levied, county clerks would have no other option but to reduce city and county tax levies by the anticipated amount of LAVTRF monies. The Proposed 1980 Budget reduces the proposed tax levy the amoun t 0 f LA VTRF . ADMINISTRATIVE BRIEFS 1. SHORTS: The Animal Shelter is proceeding slowly. Completion date is October 15, 1979. The murky water problem has improved greatly on Merrill. Mrs. Tinkler called Dean to tell him so. Vacations: Mickey Yerger, September 13 - 24; John Estes, July 25 - August 25; Bill Harris, July 23 - August 6. 2. The League of Kansas Municipalities advises that it would be stretch- ing the imagination a bit far to finance family violence progr~~s out of the Special Alcohol Fund. Monies for the Special Alcohol Fund may be used to treat the alcoholic and not the victim of child or wife abuse. 3. A check valve collapsed on Thursday, July 26, in the pump house at the Schilling sewage treatment plant. It occurred at about 7:00 P.M. and was not discovered until 8:00 A.M. Friday. Sewage filled the pump house and shorted all pumps. The plant was back in operation by 2:00 A.M. Saturday. A very messy and unpleasant job. Proper notification was sent to the State. 4. According to Mickey Yerger, a preliminary audit of expenses and revenues reveals net for the Kansas and Kenny Rogers events of approximately $28,000. The Glenn Miller Orchestra dance produced a net of about $4,000. This is a total $32,000 profit for the one week period of July 21 through July 28. This is certainly encour- aging for the Bicentennial Center. 5. Enclosed is the Projects Update. MONDAY'S MEETING 1. Larry and I would like to meet with the Commission in a brief Execu- tive Session to discuss the matter of the appeal of Judge Weckel's order of July 13. In essence, we will request authorization to file an appeal on behalf of the City in order to protect the City's rights in this case. With full understanding, if we are able to reach an agreement with the County, the appeal will be terminated. The County Commission wants to meet with the City Commission to dis- cuss this matter on Tuesday, August 7, at 2:00 P.M. in the County Commission conferenct room. You are all invited. p .
