AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES
PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE
)SE OF PAYING A PORTION OF THE COST OF
PROJECT NO. 95-938
GROUNDS OF KANSAS WESLEYAN ADDITION
Curbing, guttering, paving, grading and storm drainage of
Minneapolis Avenue from Quincy Avenue to the west line of Lot 33
and 10 feet west of the east line of Lot 32 in the Grounds of Kansas
Wesleyan University Addition.
VALLEY VIEW ESTATES ADDITION
Curbing, guttering,. paving, grading of:
Foxtail Drive from the south line of Valley View Estates Addition to
the south line of Redtop Ridge;
Redtop Ridge from the west line of Markley Road to the cul-de-sac;
Bluestein Lane from the south line of Cloud Street to the cul-de-sac;
and
the installation of sanitary sewer main and water main systems.
GICO ADDITION
Curbing, guttering, paving, and grading of:
Faith Drive from the south line of McAdams Road to the north line of
Republic Avenue;
Courtney Drive from the north line of Republic Avenue to the north
line of Bradshaw/Eastgate Drive;
Martin Avenue from the east line of :Meyer Drive to the west line of
Faith Drive;
Kaci Court from the west line of Faith Drive to the cul-de-sac;
Republic Avenue from the west line of Courtney Drive to the west
line of Lot 1, Block 3; and
The installation of a. storm drainage system.
The installation of a sanitary sewer main and the installation of
water main.
COUNTRY CLUB ESTATES NUMBER 3
The curbing, guttering, paving, grading, storm inlet, etc., for
Eastborough Road from Seitz Drive.
The installation of a water main.
The installation of sanitary sewer service lines.
WOODLAND HILLS ESTATES ADDITION
Curbing, guttering, paving, grading and drainage for Pine Ridge
Drive from the south line of Lot 10, Ftlock 1 to the north cul-de-sac.
Curbing, guttering, paving, grading and drainage for Glen Avenue
from the east line of Seitz Drive to the east line of Lot 1, Block 5.
Curbing, guttering, grading, paving and drainage for Katherine
Avenue from the east line of Pine Ridge Drive to the east line of Lot
7, Block 5.
The installation of sanitary sewer main.
The installation of water main.
REPLAT OF BLOCKS 4, 101, 11 AND 12 GEORGETOWN ADDITION
Curbing, guttering, paving, grading and related storm
drainage improvements on Seitz Drive between Pheasant Lane
and Crawford Street.
All in the City of Salina, Saline County, Kansas.
and such contracts have been duly performed, and
WHEREAS, the Board of Commissioners has determined that the total
cost of such improvements is One Million Five Hundred Thirty-five Thousand
Two Hundred Fifty-three and 78/100 Dollars ($1,535,253.78) and that 93.0
percent in the amount of One Million Four Hundred Twenty-five Thousand Six
Hundred Ninety-three and 04/100 Dollars ($1,425,693.04) be assessed against the
improvement district and that 7.0 percent in the amount of One Hundred Nine
Thousand Five Hundred Sixty and 74/100 Dollars ($109,560.74) be assessed agaist
the city -at -large.
WHEREAS, the Board of Commissioners has, after due notice, met
and determined the amount of special assessments, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas
Section 1. That special assessments to pay the cost of such
improvements, with accrued interest, be and the same are hereby levied
against the several lots, pieces and parcels of land liable for special
assessments for said improvements as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first
becoming due with the taxes levied for the year 1997 (except as otherwise
provided in the specific case of those lots referred to in Section 4 below) , and
one of said installments falling due each and every year thereafter until all
are paid and all to be collected with interest as in this ordinance provided;
HOWEVER, that the owner of any piece or parcel of property liable for any suct
assessments may redeem his property, in whole or in part, from such liability b,
paying to the City Treasurer the entire amount, or a portion thereof, chargeabl
against the same, as in this ordinance provided, at any time within thirty days
after the publication of this ordinance and before the
issuance of bonds of said City in payment of the balance of the cost of said
improvements, and to the extent of any such payment, the property so paid on
shall not thereafter be liable for any further assessments for the cost of said
improvements, nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate per
annum as shall be borne by bonds hereinafter to be issued for the payment of
the remaining unpaid cost of such improvements to be hereafter determined and
fixed by ordinance.
Section 4. In the case of Lots 17 through 21, Block 5, Georgetown
Replat 4, 10, 11, 12, the first installment shall become due with the taxes
levied for the year which is the earlier of:
a. Four (4) years from the date the special assessments would
have otherwise been levied against that lot; or
b. The date upon which that lot qualifies as a buildable lot
("buildable lot" means a lot which qualifies for the issuance of a building
permit by virtue of the availability of streets and water and sewer
utilities) .
Interest on these lots shall begin to accrue in accordance with
Section 3 above.
Section 5. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
