A public hearing to consider the vacation of a public utility easement along the west property line of
Lot 10, Block 2 of Gico Addition to the City of Salina, Kansas.
BACKGROUND:
Petition number 4280 was filed on April 20, 2006 by Jerry Sahlfeld, property owner for Lot 6, Block 1
Meyer Addition Replat of Lot 13, Block 5 and Lots 24-28, Block 6 and a strip of land on Lot 10, Block 2
of Gico Addition 21.5' wide along the west property line of the lot. Please find attached a copy of the
petition and map which helps explain the current ownership and easement layouts.
The purpose of the requested easement vacation is to facilitate the construction of a new garage on
the recently purchased portion of the adjacent property. The easement proposed for vacation, in
addition to a 20' public utility easement on the east property line of Lot 6, Block 1 of the Meyer
Addition Replat combine to provide public utility easement coverage for a 14' deep, large diameter
(27") public gravity sanitary sewer line. It is staff's position that the 30' combined easement in this
location is necessary to effectively provide access for maintenance activities on this line. In fact, when
looking along the north-south property line in this area, a similar easement configuration (consistent
25'-30' combined easement) exists for several blocks in each direction from the subject property.
Therefore, staff would recommend retaining the existing easement configuration. The east-west
portion of the easement requested for vacation contains Westar Energy and AT&T (formerly
Southwestern Bell) facilities, and they have recommended denial of the vacation of the east-west
portion of the easement.
Section 42-63 of the Salina Code was amended by the City Commission on December 9, 1991 to
disallow the construction of buildings or structure within public easements. No variance procedure
was established with that code amendment. If the City Commission accepts the staff recommendation
in this case, the applicant will not be allowed to construct any part of the proposed garage buildings in
the public utility easement.
FISCAL NOTE:
This action will have no fiscal impact to the City of Salina.
RECOMMENDED ACTION:
It is recommended that the City Commission deny the easement vacation request of the existing 10'
public utility easement along the west property line of Lot 10, Block 2 of Gico Addition to the City of
Salina, Kansas. If the City Commission disagrees with the staff recommendation, then the City
Commission should direct staff to prepare a vacation ordinance for consideration at the next City
Commission meeting.

Section 42-63. Easements.
(a) No building or structure, nor any addition thereto, shall be constructed or placed within any platted
or recorded public easement, unless expressly authorized by the board of commissioners. Prior to
granting such authorization, the city shall consult with public utilities whose lines may be affected.
In granting such authorization, the board of commissioners may impose conditions necessary to
protect any existing. A property owner may place buildings or structures not requiring a building
permit and fences, trees, shrubs and other nonstructural improvements within a utility easement at
his or her own risk (i.e., removal, relocation, or replacement) without special authorization provided
required permits have been obtained.
(b) No property owner may construct maintain or allow any natural or non-natural structures or
vegetative barriers (including but not limited to trees, shrubbery, berms, fences, walls or pole signs)
within any drainage easement dedicated, purchased or otherwise granted to the public which the City
Engineer finds obstructs, impedes, or otherwise interferes with the drainage of stormwater. Drainage
easements shall not be filled or othelWise physically altered without the written approval of the City
Engineer.
