BACKGROUND:
The attached petition was filed on March 2, 2006 by Mr. Tim Rogers, Executive Director of the Salina
Airport Authority, representing Salina Airport Authority, property owner of certain Salina Airport
Authority property in Schilling Subdivision No.5. The project is needed to facilitate proposed
development of the Eagle Med Hangar and future development of the other properties in the area.
Please see the attached petition and preliminary engineering feasibility report for a detailed
description of the benefit district.
It is prescribed by Kansas State statutes that the City Commission consider a petition for sanitary
sewer improvements and establish sufficiency on the basis that anyone of the following three
conditions are met:
1. The petition is signed by a majority of the resident owners of record of property liable for
assessment under the proposal.
2. The petition is signed by the resident owners of record of more than half of the area liable for
assessment under the proposal.
3. The petition is signed by the owners of record, whether resident or not, of more than half of the
area liable to be assessed under the proposal.
In this case, the Salina Airport Authority owns all of the property in the benefit district, therefore the
petition clearly meets the statute requirements for sufficiency. The Saline County Treasurer has
indicated that there are no delinquent taxes or special assessments on any property within the benefit
district.
The engineering feasibility report for these improvements is attached for your review. The report
describes the scope of the project, the improvement district, the method of assessment, cost estimate
breakdowns, and identifies and describes the properties in the benefit district.
The dedication of the attached 20' Public Utility Easement is needed for the proposed public sanitary
sewer improvements. This sanitary sewer line will serve the proposed Eagle Med Hangar and several
other lease sites on the benefit district property.

The property owners within the benefit district shall be assessed for one hundred percent (1000/0) of
the cost of these sanitary sewer improvements. The total estimated cost of the improvements is
$53,671.50. The property owners may chose to pay their portion of the project as a lump sum
payment in the spring of 2007 or have the costs financed over a 15 year period with the special
assessment system. City policy requires the submittal of financial security on public improvement
projects. The petitioner has the option of submitting a letter of credit for 350/0 of the project costs or
200/0 cash for financial security which will be due before the City Commission can award the bid for the
project. Due to the status of the petitioner being a public agency, the City Commission may choose to
waive the requirement for financial security in this case.
RECOMMENDATION:
It is recommended that the City Commission approve the following:
a. Resolution of Advisability/Authorization No. 06-6252 establishing the special assessment
improvement for sanitary sewer improvements in Schilling Subdivision No.5 and waive the
requirement for the financial security on the project.
b. Accept the proposed dedication of a 20' Public Utility Easement within Lots 3 and 17, Block 4,
Schilling Subdivision #5.

Hereby propose that such improvement be made in the manner provided by Article 6a, Chapter 12 of the Kansas Statutes Annotated, as
amended.
(B) The estimate or probable cost of such improvement is:
Fifty Three Thousand Six Hundred Seventy One and 50/100 ($53,671.50),
(C) The extent of the proposed improvement district to be assessed as indicated on the attached plat and is described as follows:

BEGINNING at the Southwest corner of said Block 4; thence on an assumed bearing of NOO"07'52" E along the West line of said Lot 3 a
distance of 290.000 feet; thence S89"52'08" E a distance of 451.50 feet; thence SOO"07'52" W a distance of 245.74 feet; thence on a
Non-tangent curve to the Left having a Radius of 60.00 feet, a Delta of 51"09'23", a Long Cord of which bears S31"26'54" W and measures
51.81 feet, a distance of 53.57 feet to the Southeast corner of said Lot 17; thence Na9"52'08" W along the South line of said Block 4 a
distance of 424.57 feet to the POINT OF BEGIN NING. The above described tract contains 130,134 square feet or 2.99 acres more or less.
(D) The proposed method of assessment is:
Shall be equally per square foot based upon the square footage of each lot within the Benefit District.
(E) The proposed apportionment of costs between the improvement district and the improvement district and the City-at-Iarge is:

The assessment with accrued interest to be levied as a special assessment tax upon the property

district.
APPORTIONMENT OF COST
COST CHARGEABLE TO PRIVATE PROPERTY:

100% of the total cost of the sanitary sewer improvements including the trenching,
backfill, removal and replacement of existing pavement and installation of pipe, settilt1g of
manholes and all appurtenances to make a complete system.
