Conveyance of Easement . \ CONVEYANCE OF EASEMENT 28th day of November This indenture, made this 1944, by and between: 8am Green and Harold W. Pease parties of the first party, and the City of Salina of the second part; Whereas the party of the second part. purusant to the laws of the state of Kansas. has created a lateral sewer benefit district number 196. which includes only lots one (10 to ten (10) inclusive, 13 and fourteen (14) and eighteen (18) to twenty one (21) inclusive of Block one (1) Evergreen Park addition; lots one (1) to eleven (11) inclusive of Blook one (1) h~ergremPark addition replat; lots one (1) to four (4) inclusive Block four (4) Evergreen Park addition to the city of Salina, Saline county, Kansas; and Whereas the party of the second part, as provided by law, intends to and is going to construct an eight (8) inch lateral sanitary sewer beginning at an existing laanhole in the alley between Claflin and Kirwin streets, approximate- lyone hundred and six (106) feet East of property line of Pershing Avenue and three (3) feet East of the lot line of lot two (2) Beverly Manor addition, then South parallel to and three (3) feet East of Lots two (2). three (3). and four (4) Beverly Manor addition. as an eight (8) inch sewer a distance of one hundred and sixty five (165) feet more or less to a manhole in Claflin Avenue; thence East.along Claflin Avenue one hundred and eighteen (118) feet more or less to a manhole at the intersection of Claflin and Eleventh streets; thence South in Eleventh Street one hundred and sixty nine (169) feet more or less to a manhole at the alley between Claflin and Woodlawn and Ninth and Eleventh Streets; thence east 727 feet more or less to a manhole at the intersection of the East-West and North-South alleys between Claflin and Woodlawn and Ninth and Eleventh Streets; thence North and South in alley sixty eight (68) feet more or less each direction as a six (6) inch sewer to dead ends; and. SO NOW. THEREFORE. WITNESSETH. that the parties of the first part. in consideration thereof and other good and valuable consideration, receipt of w~ioh is herebyaoknowledged, do hereby grant. bargain. sell and convey unto second party an easement across the East ten (10) feet of lots 2.3 and 4, Block 4. Beverly Manor Addition in the City of Salina. Saline County. Kansas, for the right of ingress an egress and the piling of dirt during the construction of aforesaid sewer across Lot 22. Block 2. Pleasant View Addition. and for the movement of necessary equipaent for construction purposes. The party of the second part agrees to leave the land in as good con- dition as it now exists.
