'.~ :- f{.~~ II~ f ~ (~v ~ (¡-f<,;., ~ 2".£3 PROTEST PETITION COllies now the Union Pacific Railroad Company and protests the Resolution 2677 passed by the Ronorable Board of Commissioners of the City of Salina, Saline County, x.naas, on November 27, 1962, and first published in the Salina Journal on December 1, 1962, said resolution authorizing and ordering certain street, sewer and water mains and hydrant improvements and ordering preparation of plans and specifications and the estimate of costs of sald improvements. all to be installed on North Ohio Street in the City of Salina from Elm Street to pacific Street. This protest is directed toward the method of assessment of the costs of said improvement asainst the adjoining property owners and not against the improvement itself. The property owned by the petitioner that is within the improvement area is described as follows: PARCEL 1 Beginning at a point in the south right-of-way line of Union pacific Railroad, said point being 50', measured at right angles, southerly of centerline of Union Pacific main track and 200', measured at right angles, east of centerline Ohio Street, thence north along a line parallel to and 200' from the said centerline of Ohio Street, a distance of 419.7', morc or less. to a point lying 30', measured at right angles, south of centerline U.S. Highway 40-S, thence west along Union Pacific right-of-way line, which line is parallel to said center line highway. a distance of 200' to a point in the centerline of Ohio Street. which point being 30'. measured at right angles. south of said centerline highway, thence south along a line representing both the centerline Ohio Street and the Union Pacific right-of-way line, a distance of 228.3'. more or less. to a point which is 200', measured at right angles. northerly of center line Union Pacific main track, thence westerly along Union Pacific right-of-way line a distance of 215.2', more or less. thence south across Union Pacific right-of-way along a line parallel to said centerline Ohio Street. a distance of 269.0', more or less, to a point in the south right-of-way line of Union Pacific Railroad, thence easterly along said south right-of-way line, a distance of 430.4'. more or less. to point of beginning.
