TITLE OPINION
All that part of the Northwest Quarter of the Northeast
Quarter of Section Eleven (11), Township Fourteen (14)
South, Range Three (3) West of the 6th Principal Meridan,
in Saline County, Kansas, lying South of the center line
of Woodland Avenue. (a public street in Pacific Addition
to the City of Salina) extended due West from the point
of intersection of said center line of Woodland Avenue
with the West line of Thirteenth Street (also a public
street in Pacific Addition to the City of Salina) to the
East line of the right-of-way condemned by the City of
Salina for enlarging and straightening the channel of
Dry Creek, East of the East line of said right-of-way and
North and West of center of the old channel of Dry Creek.

Dear Mr. Morrison:
I have this date examined the Abstract of Title to the above
described real estate "hich Abstract consists of C. W. Lynn Abstract
Company abstract number 50745 containing 44 entries and 72 pages.
Assuming the correctness of the abstract and that the exhibits and
affidavits set forth therein are true. I am of the opinion that
merchantable title is vested in MILTON L. ~~RRISON, subject to the
following requirements and conditions:
1. At entry 34 there appears an oil and gas lease dated
November 22, 1937, for a term of 10 years. I require that an af-
fidavit of non-prcduction be recorded and shown in the abstract.
stating that no oil or gas was produced during the primary or
definite term of the lease. You should also satisfy yourself that
no one is in possession claiming under such oil and gas lease.
and that neither oil nor gas is actually being produced from the
real estate.

2. Several entries in the Abstract mention an easement in
favor of the Union Pacific, Lincoln, and Colorado Railway Company.
The grant of easement is not entered in the Abstract, and therefore
could not affect the title to the real estate involved in this
examination. No requirement is made concerning said easement.
3. You should ascertain the rights of all persons in possession
of said property.
4. You should ascertain the correct location of the boundary
lines and also whether there are any encroachments.
S. You should ascertain whether or not there are any existing
violations of the County Zoning Ordinances of Saline County, Kansas.
6. You should ascertain whether any materials, equipment or
supplies were used or consumed on the premises or labor performed
within the last four months which might form the basis for a mechanics
lien.
7. The abstract does not show proceedings pertaining to the
care and treatment of mentally ill persons and adoption proceedings.
8. The abstract does not show instruments filed under the
Uniform Commercial Code.
9. Kansas law provides that if a suit is commenced, the
judgment which may be rendered in the suit shall be effective from
the time of the filing of the petition in such suit for a period
not exceeding four months prior to the entry of the judgment.
Because no lawsuits appear of record entered in the abstract, I
therefore assume that no suits were pending against the seller as
of the date the sale of said real estate was closed.
10. Your attention is called to the fact that changes in laws,
regulations, and legal practices may make the present abstract form
obsolete; therefore, no warranty or opinion is made as to the form
or condition of the abstract subsequent to this examination.
11. The taxes for the year of 1968, and prior years have
been pail in full.
12. The abstract was last certified by the C. W. Lynn Abstract
Company, Inc., on February 17, 1969, at 3:45 o'clock P.M.
