Application of Eldon W, Moyer et.al, for vacation of alleyway
Dear Commissioners:
I am writing to you as attorney representing SEI Partners, L,P, and
Dennis sperling, said parties being "adjoj.ning owners" of that
certain alley requested to be vacated by the above application,
SEI Partners, ¡..P., and Dennis Sperling consider themselves
"adjoining owners", in accordance with the findings of the Kansas
Court of Appeals in Garber Enterprises. lnc, v, citv of Lawrence,
14 Kan, App 656 (1990) since they are property holders of property
significantly affected by the proposed vacation of the adjacent
alley.
In accordance with the provisions of K.S,A, 12-505, consider this
communication the formal written objection of SEI Partners, L,P"
and Dennis Sperling to the application above referenced.
The above referenced parties further object to the described
alleyway proposed. to be vacated, said description being potentially
applicable to any of six different alleyways lying between Highland
Avenue and Ninth Street and located in the Grounds of Kansas
Weslyan University Addition.
