We, the undersigned, being residents and property owners in
the City of Salina, Kansas, do hereby petition your honorable body for:
The vacation of the existing 45-foot wide street right-of-way for the North Ninth Street Frontage Road located
between Diamond Drive and Gold Road as shown on Exhibit "An. The applicant submits Exhibit "B", as prepared
by his architect Mr. Warren Ediger, to illustrate the concept plan for the private improvements. The applicant
requests conditions of the vacation as indicated on Exhibit 'C".

PETITION FOR VACATION OF NORTH NINTH STREET
FRONTAGE ROAD RIGHT-OF-WAY
EXHIBIT "C"
The following conditions apply to the attached petition for vacation of the
North Ninth Street Frontage Road right-of-way:
1.
Upon vacation of the frontage road right-of-way, the owner/tenant
shall provide private improvements to the site substantially compliant
with the attached Exhibit "6" entitled "Amoco North Ninth Street
Concept Plan". The final plans for the site improvements shall
comply with all current city codes and regulations. City may
particìpate in interim pavement repairs in vacated area.
Upon approval by the City of Salina of the final site plan/building
permit for the Amoco Station, the owner/tenant may enter into a
license agreement with the City of Salina for the jòint development of
the enhanced landscape plan along North Ninth Street.
Upon vacation of the frontage road right-of-way, the City of Salina
shall initiate the redesign and reconstruction of the intersection of
North Ninth Street and Diamond Drive to improve traffic safety and
access to all vehicles. The cost of all design and construction shall
be bome by the City of Salina. The design and construction shall be
consistent with the Amoco Station site improvements. The property
owner/tenant shall have the opportunity to review and comment on
the intersection design documents.
Upon vacation of the frontage road right-of-way, the City of Salina
shall initiate the redesign and reconstruction of the public storm
drainage system currently located in the median between North Ninth
Street and the frontage road, and between Diamond Drive and Gold
Road. The cost of all design and construction shall be borne by the
City of Salina. The design and construction shall be consistent with
the Amoco Station site improvements. The property owner/tenant
shall have the opportunity to review and comment on the storm
drainage design documents. .
Upon vacation of the frontage road right-of-way, this land shall revert
to the ownership of the D.L. Sampson Trust #1 with no additional land
transaction costs.
