Lot 1, Block 1DRAINAGE EASEMENT This Indenture, made this 8th day of December, 1997, by and between Belmont Hotels, LLC, a Corporation, Party of the First Part and THE CITY OF SALINA, KANSAS, a municipal corporation, Party of the Second Part, WITNESSETH: That the said Parties of the First Part for a good and valuable consideration receipt and sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and convey unto said Party of the Second Part an easement in, over and across certain tracts of land owned by the Parties of the First Part more particularly described as follows: A tract of land located in Lot 1-revised, Block 1, Replat of Lot 3, Block 3, Belmont Plaza Addition to the City of Salina, Saline County, Kansas, for storm drainage easement purposes and described as follows: Beginning at a point on the East right-of-way line of Interstate Highway 135, said point also being the Southwest comer of said Lot 1-revised; Thence N 00014' 55" W on the West line of said Lot 1-revised, a distance of 260.04 feet; Thence S 89° 47' 17" E a distance of 42.00 feet; Thence S 00° 14' 55" E a distance of 39.32 feet; Thence S 19° 25' 00" E a distance of 245.88 feet; Thence S 89° 46' 31"E a distance of 70.00 feet; Thence S 00° 13' 29" W a distance of 28.46 feet to a point on the South line of said Lot 1- revised; Thence N. 89 ° 46' 31" W on said South line a distance of 178.79 feet to the Point of Beginning. Hotel s, for all of the rights of ingress and egress of the said Party of the Second Part, its servants, officers, employees and contractors for the purpose of the construction, repairing, replacing and maintaining a public drainage system, in perpetuity. IN WITNESS WHEREOF, the said Belmont Hotels, LLC hereunto has caused this easement to be signed on its behalf by its proper officers who are duly authorized to do so and has caused its corporate seal to be affixed, the day and year first above written.
