UTILITY EASEMENT
THIS INDENTURE, made this .;1.5'1' day of /llJd;j. , 1999, by and between D-R-S
PARTNERSHIP, a Kansas General Partnership (the ,,~, and the CITY OF SALINA,
KANSAS, a municipal corporation (the "City").
WITNESSETH: The Grantor for good and valuable consideration the receipt and
sufficiency of which are hereby acknowledged, does hereby grant, bargain, sell, and convey unto
the City, a Utility Easement in, through, over, and across a certain portion of land owned by the
Grantor, more particularly described as follows:
A tract of land in the West Half (WY2) of the Southwest Quarter (SW~) of Section
Thirty-six (36), Township Thirteen (13) South, Range Three (3) West of the Sixth
P.M. in Saline County, Kansas, being more particularly described as follows:
Commencing at a point on the South right-of-way line ofI- 70 Highway that is thirty
feet (30') West of the East line of the West half (WY2) of the Southwest Quarter
(SW~) of said Section Thirty-six (36); thence SOooOO'OO"W a distance of four
hundred one and fifty-seven hundredths feet (401.57'); thence N90o00'00"W a
distance of the two hundred fifty feet (250') to the point of beginning; thence
SOooOO'OO"E a distance of two hundred fifty-nine and three hundredths feet
(259.03'); thence N90o00'00"W a distance of thirty feet (30'); thence SOooOO'OO"E
a distance of twenty feet (20'); thence S90o00'00"E a distance of fifty feet (50');
thence NOooOO'OO"E a distance of two hundred seventy-nine and three hundredths
feet (279.03 '); thence N90o00'00"W a distance of twenty feet (20') to the point of
beginning. Said tract contains 0.142 acres, more or less.
for all rights of ingress and egress of the City, its servants, officers, employees, contractors, and
franchisees, for purposes of the construction, installation, repairing, replacing, and maintaining a
public water main, valves, and hydrants in perpetuity.
IN WITNESS WHEREOF, the duly authorized General Partners of the Grantor have
signed this Utility Easement on behalf of the partnership the day and year first above written.
