TRANSFER
Steele, Inc. and CLIS, Inc., Owners, hereby warrant that they own
the absolute title to that certain water line constructed by them in the
Right-of-Way of U. S. Highway 81, from Otis Street North to a point approxi-
mately 400 feet North of the Right-of-Way of 1-70 Highway, and all cross-
overs, the fire plugs, valves and all appurtenances thereto, and that all
of the same are free of liens, rights, claims or encumbrances.
Owners represent that said water line and appurtenances are situate
in the Right-of-Way of U. S. 81 and 1-70 except that certain portion thereof
situate within the confines of that certain easement, the original of which
is attached hereto, recorded in the Offi~ of the Register of Deeds of Saline
County, Kansas, in Miscellaneous Book 79, pages 280~and 281.

Owners, in consideration of the payment of $47,651.20, hereby
transfer, convey and warrant unto the City of Salina: Saline County, Kansas:
(1)
The said water line and the appurtenances thereto;
and,
(2) All of the right, title and interest of Owners in, to
and under the terms, conditions and provisions of that certain easement,
dated December 11, 1962, and recorded at the time and place, aforesaid.

CONVEYANCE OF EASEMENT

THIS INDENTURE, made this / -ãay of December, 1962, by and
between L. S. NELSON and CORA J. NELSON, his wife, of the first part,
hereinafter referred to as "NELSON" and STEELE, INC., and CLIS, INC., both
Kansas corporations with their principal place of business in Salina,
Kansas, hereinafter referred to as "CORPORATIONS" and the CITY OF SALINA,
KANSAS, hereinafter referred to as the IICITylI, they being the parties of
the second part.
WHEREAS, the parties of the second part desire to obtain an ease-
ment over, upon and through certain land owned by Nelson hereinafter
described; and,
WHEREAS, Nelson is the owner of the fee simple title to said land
and is willing to grant said second parties the desired easement under the
terms and conditions hereof; and,
SO NOW, THEREFORE, witnessed, that Nelson in consideration of the
payment of the sum of $250.00, receipt of which is hereby acknowledged,
does by these presents, grant, bargain, sell and convey unto the Corporations
an easement for the purpose of constructing, installing, repairing, replacing
and maintaining a water line and appurtenances thereto for a term of five (5)
years from the date the lands hereinafter described are incorporated in
the limits of Salina, Kansas, and thereafter in perpetuity unto the City in,
over and across that certain portion of land owned by Nelson more particularly
described as follows:
That certain portion of the Southeast Quarter (SE/4) of
Section Thirty-five (35), Township Thirteen (13) South,
Range ~(W~st C£ the 6th P. M. described as
follows:Thrèe' 3)
Beginning at a point on the West right-of-way line of
U. S. Highway No. 8l Four Hundred (400) feet North of
the South line of said quarter section, thence North
along said right-of-way line Three Hundred (300) feet,
thence West parallel with the South line of said quarter
Section Fifteen (l5), thence South by East in a straight
line to a point Five (5) feet West of the place of
beginning, thence East Five (5) feet to the place of
beginning.
