RIGHT-OF-WAY GRANT
THIS EASEMENT, Made and entered into by The Planters State
Bank, as Testamentary Trustee of the Estate of E. H. Sudendorf,
Deceased, as Grantor, and the City of Salina, Kansas, as Grantee,
' this ..!¡:!i;:jfay of March, 1960;
WITNESSETH:
WHEREAS, the City of Salina has heretofore acquired, by
. condemnation, certain rights-of-way for levee, channel change,
' construction easements, flow-way easements, etc., over certain
i land owned by The Planters State Bank, Testamentary Trustee of
the Estate of E. H. Sudendorf, Deceased, described as the
Southeast Quarter (SEt) of Section Thirty (30), Township Fourteen
(14) South, Range Two (2) West of the 6th P. M. in Saline County,
Kansas, all in connection with its flood protection program; and,
WHEREAS, Grantor desires to have constructed by the City
of Salina, and/or the Corps of Engineers, a drainage ditch from
the drainage structure under the levee to the new channel of the
Smoky Hill River as hereinafter described, and the City of Salina,
Kansas, through the Corps of Engineers, is willing to construct
said drainage ditch provided the landowner provides the City of
Salina with a permanent easement for such drainage ditch purpose:
NOW, THEREFORE, in consideration of the mutual benefits to
be received, and other good and valuable consideration, receipt
of which is hereby acknowledged, the undersigned owner of the
i land hereinabove described, does hereby grant unto the City of
, Salina a permanent easement twenty feet (20') wide each side of
~' the existing drainage ditch described as follows:
Beginning at a point on the City of Salina owned
right-of-way two hundred forty (240) feet south
of and seven hundred twenty-five (725) feet east
of the northwest corner of the southeast quarter
(SEt) of said Section Thirty (30), thence easter-
ly along the existing low to a point on City of
Salina owned right-of-way one hundred fifty (150)
feet South of and twelve hundred (1200) feet east
of the northwest corner of the Southeast Quarter
(SEt) of said Section Thirty (30), and containing
0.5 acres more or less;
provided, however, that the undersigned Grantor shall have full
right of access over and across said easement ditch so long as
said access rights do not interfere with the drainage provided for:
by said ditch.
IN WITNESS WHEREO~, the Grantor has caused this easement to
be executed this ~y of March, 1960.

BE IT REMEMBERED That on this f1f::'"day of March, 1960, before
me, the undersigned, a Notary Public in and for the County and
State aforesaid, came H. B. Eagle, Assistant Trust Officer of The i
Planters State Bank, Salina, Kansas, who is personally known to
be to be such officer and who is personally known to me to be the.
person who executed, as such officer, the within instrument of '
writing on behalf of such Planters State Bank, and such person
duly acknowledged the execution of the same to be the act and
deed of said corporation.
