DEDICATION OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That James C. McVay and Sarah Jane McVay,
husband and wife, Gail E. Sprague and Elizabeth Dale
Sprague, husband and wife, and C. N. Hoffman as executor
of the estate of Claire Dell Hoffman, do hereby grant,
dedicate and assign to the City of Salina, Kansas, for use
as a public pedestrian walkway the following described
tract bf land, to-wit:
A tract of land located in the Northeast
Quarter (NE/4) of Section 26, Township 14
South, Range 3 West of the Sixth Princi-
pal Meridian in Saline County, Kansas,
being more particularly described as
follows:
Beginning at a point that is 400' (ft.)
east and 770' (ft.) south of the north-
west corner of the Northeast Quarter
(NE/4) of the Northeast Quarter (NE/4)
of said Section 26, said point being the
southwest corner of the Hageman School
property; thence west 69' (ft.) more or
less to the east right~of-way line of
U. S. Highway 81; thence northwesterly
along said right-of-way line a distance
of 19.8' (ft.); thence east a distance
of 82' (ft.) more or less to a point on
the west line of the Hageman School property,
said point being 400' (ft.) east and 755'
(ft.) south of the northwest corner of
the Northeast Quarter (NE/4) of the
Northeast Quarter (NE/4) of said Section 26;
thence south a distance of 15' (ft.) to the
point of beginning; said tract contains
0.03 acres more or less;
provided that in the event the City of Salina, Kansas, has
not laid out and constructed a permanent pedestrian sidewalk
of three feet or more in width transpiring said tract along
its east and west length prior to July 1,1974, then this
dedication shall be null and void, otherwise said dedication
shall continue for so long as used for pedestrian walkway
purposes by the general public.
