PERMANENT DRAINAGE EASEMENT
THIS INDENTURE, made this .2tJÆ= day of November, 2001, by and between
CAROL YN J. BENNETT, Trustee of the CAROLYN J. BENNETT TRUST dated -3 -' :L ()
j'19~, (the "Grantor"), and the City of Salina, Kansas, a municipal corporation, (the "City").
WITNESSETH: The Grantor for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, does hereby grant, bargain, sell, and convey unto
the City, a permanent drainage easement in, through, over, and across a certain portion of land
owned by the Grantor, as legally described on the attached and incorporated Exhibit A and as
depicted on the Engineering Drawing attached and incorporated as Exhibit B (the "Permanent
Drainage Easement") and for all rights of ingress and egress of the City, its servants, officers,
employees, contractors, and franchisees, for purposes of constructing and maintaining drainage
structures and flowways, in perpetuity.
IN WITNESS WHEREOF, the Grantor has signed this Permanent Drainage Easement the
day and year first above written.

A tract ofland in the Northeast Quarter (NE ~) of Section 19, Township 14 South, Range
2 West, of the Sixth Principal Meridian, in the City of Salina, Saline County, Kansas, and
being more particularly described as follows:
Commencing at the Southwest (SE) Comer of the Northeast Quarter (NE~) of said
Section 19; thence N 00° 39' 13" E, along the East line of said Northeast Quarter (NE ~),
a distance of 129.25 feet; thence N 89° 20' 47" W, perpendicular to said East line, a
distance of 40.00 feet, to a point on the West Right of Way line of Marymount Road, and
the true POINT OF BEGINNING; thence N 89° 35'08" W, parallel with the South line
of said Northeast Quarter (NE IA), a distance of 15.16 feet, thence N 00° 38' 33" E, a
distance of 19.55 feet; thence S 89° 21' 27" E, a distance of 15.16 feet, to a point on the
West Right of Way line of Marymount Road; thence S 00° 39' 13" W, along the West
Right of Way line of Marymount Road, a distance of 19.27 feet, to the POINT OF
BEGINNING.
