CONVEYANCE OF EASEMENT
TI-IIS llIDENTURE, made this

1946, by and between THE NAZARETH CONVENT AND ACADEMY of Concordia,
Kansas, party of the first part, and the CITY OF SALINA, 1C~~SAS, of
the second part:
WHEREAS, the party of the second part, pursuant to the laws of
the State of Kansas and the ordinances of the City of Salina, has de-
termined it neces sary to extend the water mains of the City of Salina;
and
1TIIEREAS, the party of the second part, as provided by law, in-
tends to and is going to cause to be constructed said extension;
SO NOW, TBEREFORE, WITNESSETH, That the party of the first part,
in consideration thereof and other good and valuable consideration,
receipt of which is hereby acknowledged, doth hereby grant, bargain,
sell and convey unto second party an easement in, over and across cer-
tain lands owned in fee simple absolute by first party, more particu-
larly described as follmvs, to~vit:
A tract of land in Section Eighteen (18), Township
Fourteen (14) South, Range Two (2) West of the 6th
P. M., described as follows: A ten (lor) foot strip
of land, the center line of which begins on the north
section line of said Section Eighteen (18) and 341.0
feet west of the northeast corner of said Section
Eighteen (18), thence south a distance of 105.0 feet;
all for the right of ingress and egress by party of second part, its
servants, officers, employees and contractors therefor, for the purpose
of constructing, maintaining, repairing and replacing a six (6) inch
water main, and all connections and other appurtenances thereto, all in
accordance with the plans and specifications now on file in the office
of the City Clerk of the City of Salina, which such plans and specifi-
cations are hereby incorporated herein and made a part hereof by refer-
ence.
First party covenants that it will warrant and forever defend the
interest herein conveyed unto second party and its successors, against
said first party, its successors and assigns, and every other person
whomsoever, lawfully claiming or to claim the same.

The Conditions of this conveyance are such that:
(A)
It is understood that said water main will traverse the top
segment of a certain heat tunnel above the steam conveyance lines and
that in such traversing the second party herein will well and truly seal
the entrance and exit into and therefrom and will insulate the water
main all so as not to reduce the efficiency of said steam lines in the
conveyance of heat; and second party agrees that in the event said trav-
ersing shall cause damage to said heat tunnel or the equipment therein,
for any cause, at any time, that prompt restoration will be effected.
(B)
That in the constructing, maintaining, repairing and re-
placing of said water mains that second party will on and after each
entry timely restore the top soil, flowers and shrubs to their original
state and condition as nearly as practicable;
(C)
That second party will install and maintain a fire hydrant
at the place designated on the attached plat, marked, "Exhibit A", which
is hereby incorporated herein.
