91-4376 Eminent DomainRESOLUTION NUMBER 91-4376 i I A RESOLUTION AUTHORIZING THE PAYMENT OF THE APPRAISERS' AWARD AND REQUESTED FEES IN CONDEMNATION. WHEREAS, the City filed a condemnation proceeding (Saline County District Court Case No. 91 CVC 193) in order to acquire real estate for the purpose of constructing a City vehicle fueling facility and utility distribution warehouse, legally described as follows: A parcel of land being all of Lots Forty (40), Forty-two (42), Forty-four (44), Forty-six (46), and Forty-eight (48) on Third Street, all of Lots Forty-five (45) and Forty-seven (47) on Fourth Street and all that portion of Lots Thirty-nine (39), Forty-one (41) and Forty-three (43) on Fourth Street lying east of a straight line drawn from the southwest corner of said Lot Forty-three (43) to a point on the north line of said Lot Thirty-nine -nine 39 Y ( ) that is 25.0 feet east, measured along said north line, from the northwest corner of said Lot Thirty-nine (39), Original Townsite to the City of Salina Saline County, Kansas together with the vacated alley lying between said lots as vacated by Ordinance No. 2181 approved May 26, 1918, EXCEPTING therefrom, the south 22.0 feet of the west 12.0 feet of said Lot Forty-seven (47) . (The "Property") . WHEREAS, on August 30, 1991 the Court appointed panel of three appraisers submitted its report determining the value of the Property to be $12,072; and WHEREAS, the three appraisers have each requested and the Court has approved fees of $1,040 per appraiser; SO NOW, THEREFORE BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That the City Manager is directed to pay in to the Clerk of the Saline County District Court the sum of $15,192, plus any court costs, in order to acquire the Property for use by the City. Section 2. That this resolution shall be in full force and effect from and after its adoption. Adopted by the Board of Commissioners and signed by the Mayor this 9th day of September, 1991. S ephe C.
