PERMANENT DRAINAGE EASEMENT
THIS INDENTURE, made this '3 tt-& day of November, 2001, by and between
CHARLES E. STEVENS JR., Trustee of the CHÃRLES E. STEVENS JR. TRUST NO.1, dated
Ju1 y 31, 19 ZQ...., (the "Grantor"), and the City of Salina, Kansas, a municipal corporation, (the
"City").
WITNESSETH: The Grantor for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, does hereby grant, bargain, sell, and convey unto
the City, a permanent drainage easement in, through, over, and across a certain portion of land
owned by the Grantor, as legally described on the attached and incorporated Exhibit A and as
depicted on the Engineering Drawing attached and incorporated as Exhibit B (the "Permanent
Drainage Easement") and for all rights of ingress and egress of the City, its servants, officers,
employees, contractors, and franchisees, for purposes of constructing and maintaining drainage
structures and flowways, in perpetuity.
IN WITNESS WHEREOF, the Grantor has signed this Permanent Drainage Easement the
day and year first above written.

A tract of land in the Northwest Quarter (NW ~) of Section 20, Township 14 South,
Range 2 West, of the Sixth Principal Meridian, in the City of Salina, Saline County,
Kansas, and being more particularly described as follows:
Commencing at the Southwest (SW) Comer of the Northwest Quarter (NW IA) of said
Section 20; thence N 00° 39' 13" E, along the West line of said Northwest Quarter (NW
~), a distance of 120.54 feet; thence S 89° 20' 47" E, perpendicular to said West line, a
distance of 40.00 feet, to a point on the East Right of Way line of Marymount Road, and
the true POINT OF BEGINNING; thence S 89° 21' 27" E, a distance of 14.85 feet;
thence N 00° 38' 33" E, a distance of 84.00 feet; thence N 89° 21' 27" W, a distance of
14.83 feet, to a point on the East Right of Way line of Marymount Road; thence S 00°
39' 13" W, along the East Right of Way line of Marymount Road, a distance of 84.00
feet, to the POINT OF BEGINNING.
