EASEMENT
This Indenture, made this 1/ day of fi44/ , 1994, by and
between LEE HAWORTH CONST. CO., INe. Party of the First part and THE CITY OF
SALINA, KANSAS, a municipal corporation, Parties of the Second part, WITNESSETH:
That the said Party of the First part for a good and valuable consideration receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and convey
unto said Parties of the Second part an easement in, over and across a certain tract of land owned
by the Party of the First part more particularly described as follows:
A parcel ofland located in Lot 7, Block 4, Twin Oaks II Subdivision in the City of
Salina, Saline County, Kansas, described as follows:
Beginning at the Southeast comer of Lot Seven (7), Block Four (4), in Twin Oaks
II Subdivision, in the City of Salina, Saline County, Kansas, thence Westerly on an
assumed bearing of North 90 degrees 00 minutes 00 seconds West along the South
line of said Lot Seven (7), a distance of 45.12 feet to a non tangent curve with a
chord bearing of North 41 degrees 33 minutes 27 seconds East, said curve having
a radius of 40.00 feet and an arc length of 67.64 feet, thence Northeasterly along
said arc, a distance of 67,64 feet, to a point on the East line of said Lot Seven (7);
thence South 06 degrees 53 minutes 06 seconds East, along said East line, a
distance of 45.12 feet back to the point of beginning.
The above described tract ofland contains 452.00 square feet, more or less.
for all of the rights of ingress and egress of the said Parties of the Second Part, its servants,
officers, employees and contractors for the purpose of the construction, installation, repairing,
replacing and maintaining a sanitary sewer pipeline, in perpetuity.
