EASEMENT
This Indenture, made this 17 day of ~I/~~ , 1994, by and
between LEE HAWORTH CONST CO" INe, Party of the First part and THE CITY OF
SALINA, KANSAS, a municipal corporation, Parties of the Second part, WITNESSETH:
That the said Party of the First part for a good and valuable consideration receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and convey
unto said Parties of the Second part an easement in, over and across a certain tract of land owned
by the Party of the First part more particularly described as follows:
A parcel ofland located in Lot 3, Block 4, Twin Oaks III Subdivision in the City
of Salina, Saline County, Kansas, described as follows:
Beginning at the Southwest corner of said Lot Three (3), thence North 75 degrees,
23 minutes, 31 seconds East along the South line of Lot Three (3), a distance of
7,75 feet to a point on said South line; thence North 00 degrees, 00 minutes, 00
seconds East and perpendicular to the North line of said Lot Three (3), a distance
of 114,78 feet to a point on said North line; thence North 90 degrees, 00 minutes,
00 seconds West along said North line a distance of 41.69 feet to the Northwest
corner of said Lot Three (3), said point intersecting a non tangent curve to the
right with a chord bearing South 16 degrees, 19 minutes, 34 seconds East, said
curve having a radius of370,00 feet; thence Southerly along the arc of said curve a
distance of 122,19 feet to the point of beginning,
The above described tract ofland contains 2,45534 square feet, more or less,
for all of the rights of ingress and egress of the said Parties of the Second Part, its servants,
officers, employees and contractors for the purpose of the construction, installation, repairing,
replacing and maintaining a sanitary sewer pipeline, in perpetuity,

That portion of Lot Three (3), Block Four (4) in Twin Oaks III
Subdivision in the City of Salina, Saline County, Kansas, as described
as follows:
Beginning at the Southwest corner of said Lot Three (3), thence N 75
degrees 23 minutes 31 seconds East along the South line of Lot Three
(3), a distance of 7.75 feet to a point on said South line;
- thence N 00 degrees 00 minutes 00 seconds East and perpendicular
to the North line of said Lot Three (3), a distance of 114.78 Feet to a
point on said North line;
- thence North 90 degrees 00 minutes 00 seconds West along said
North line a distance of 41.69 Feet to the Northwest corner of said Lot
Three (3), said point intersecting a non tangent curve to the right with
a chord bearing South 16 degrees 19 minutes 34 seconds East, said
curve having a radius of 370.00 Feet;
- thence Southerly along the arc of said curve a distance of 122. 19
