CONVEYANCE OF EASEMENT

THIS AGREEIv'..ENT, made this It ~ day of November, 1948, by
and between GROVER M. SIMPSON and ~ßRY I. SIMPSON, his wife, herein-
after called Grantors, and the CITY OF SALINA, KANSAS, hereinafter
called Grantee.
WITNESSETH, that:
~nEREAS, pursuant to the laws of the State of Kansas, Grantee
intends to and is going to construct a fifteen-inch (15") storm sewer,
running northward from the north edge of East Iron Avenue to the Smoky
Hill River, commencing at the intersection of said avenue and the north-
ern terminus of Iowa Avenue; and
VlliEREAS, for said purpose an easement is needed by Grantee
over, in and across certain lands of Grantors, more particularly de-
scribed as follows, to-wit:
The West 10 feet of the East 619 feet of the
West 694 feet of Lot One (1) in Surveyor's
Plat Thirty-four (34) and the East 10 feet of
the West 85 feet of Lot Two (2) in Surveyor's
Plat Eighteen (18) in Saline County, Kansas;
and
NOW, THEREFORE, Grantors in consideration of the foregoing
premises and the sum of $200.00 to them paid by Grantee, receipt of
which is hereby acknowledged, and in consideration of the express con-
ditions hereinafter stated, do hereby grant, bargain, sell and convey
unto Grantee an easement in, over and across the aforesaid lands, for
the right of ingress and egress by Grantee, its servants, officers,
employees and contractors, and for the purpose of constructing, main-
taining, repairing and replacing said storm sewer and all connections
and other appurtenances thereto in accordance with the plans and spec-
ifications now on file in the office of the City Clerk of the City of
Se.lina, which plans and specifications are hereby incorporated herein
and made a part hereof by reference.
It is specifically understood and agreed this easement is
granted upon the express condition that, notwithstanding any of the
foregoing provisions, the top surface of said fifteen-inch (15") storm
sewer shall be installed and buried at least thirty (30) inches below
the surface of said land; that during the installation of said sewer
Grantee shall have the temporary right to use, and store dirt, mater-
ials and equipment upon the additional fifteen (15) feet of land next
east of and adjacent to the above described land; and that as soon as
said sewer is installed, Grantee shall immediately remove all dirt,
materials and equipment stored on said fifteen (15) feet of land during
the construction work and shall immediately restore said fifteen (15)
feet of land to its pre-existing condition.
IN WITNESS WHEREOF, Grantors have executed and delivered this
instrument the day and year first herein written.
