PERMANENT EASEMENT
THIS INDENTURE, made thi s 23rd day of Aug. ,
1988, by and between ARCHIE J. FRY, a widower, and DENNIS M.
FRY and DAWN FRY, husband and wife, (the "Grantors"), and
the CITY OF SALINA, KANSAS, a municipal corporation (the
"City").
WITNESSETH: The Grantors for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The West 5 feet of the East 40 feet of Lots 10 and 11
in Surveyor's Plat No. 12 to the City of Salina, Saline
County, Kansas, containing 500 square feet, more or
less.
This permanent easement (5 feet) to lie West of and
immediately adjacent to the 35 feet of right-of-way on
the West side of Ohio Street, as described above.
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.

CITY OF SALINA, KANSAS, a municipal corporation (the
"City"):
WITNESSETH: That the Grantors, for good and valuable
consideration, receipt of which is hereby acknowledged, do
hereby grant, bargain, sell, and convey unto the City, that
certain portion of land owned by the Grantor, more
particularly described as follows:
The West 8 feet of the East 35 feet of Lots 10 and 11
in Surveyor's Plat No. 12 to the City of Salina, Saline
County, Kansas, containing 800 square feet, more or
less.
The above-described tract (8 feet) lying West of and
immediately adjacent to the existing 27 feet of
right-of-way on the West side of Ohio Street, which was
acquired as follows: 20 feet dedicated for roadway
right-of-way as recorded in the office of the Saline
County Register of Deeds in Road Record Book "C", page
141 and dated April 4, 1907; 7 feet acquired by
condemnation for the widening of Ohio Street as stated
in Ordinance No. 3783, passed on September 16, 1929.
This conveyance will establish the West right-of-way
line of Ohio Street as being 35 feet West of and
parallel with the East line of the Northeast Quarter of
Section 13, Township 14 South, Range 3 West.
as public right-of-way for the purpose of constructing,
installing, repairing, replacing, and maintaining a public
street and public utilities, in perpetuity.
IN WITNESS WHEREOF, the Grantor has hereunto caused
this instrument to be execut the day and year first above
