PERMANENT EASEMENT
THIS INDENTURE, made this 23rd day of Aug.
1988, by and between ARCHIE J. FRY, a widower (the
"Grantor"), and the CITY OF SALINA, KANSAS, a municipal
corporation (the "City").
WITNESSETH: The Grantor for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, does hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The West Five (5) feet of the East Forty (40) feet
of Lot Nine (9) in Surveyor's Plat No. 12 to the
City of Salina, Saline County, Kansas, containing
800 square feet, more or less.
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.

PERMANENT EASEMENT
The West 5 Ft. of the East 40 Ft. of Lot 9, Surveyor1s Plat No. 12 to the City
of Salina, Saline County, Kansas, containing 250 Sq. Ft., more or less.
This permanent easement (5 Ft.) to lie West of and immediately adjacent to the
35 Ft. of right-of-way on the West side of Ohio Street, which was acquired as
fo 11 ows :
20 Ft. dedicated for roadway right-of-way as recorded in the office of the Saline
County Register of Deeds in Road Record Book "C", page 141 and dated April 4, 1907;
7 Ft. acquired by condemnation for the widening of Ohio Street as stated in
Ordinance No. 3783, passed on September 16, 1929; also, an additional 8 Ft. of
right-of-way was acquired from Lot 9 in Surveyor1s Plat No. 12 by Quit Claim as
recorded in the office of the Saline County Register of Deeds in Deed Book 95,
Page 174 and dated December 3, 1930.
