WHEREAS, the District Court of Saline County, Kansas,
on the petition of Robert Burkhardt, administrator of the
estate of Alvin V. Burkhardt, deceased, entered an order on
Júnua HI / ~ , 198~, approving the granting of a permanent
easemen~ through, over and across the following described
real estate situated in the County of Saline, State of
Kansas, to wit:
The West 5 feet of the East 40 feet of the
South 50 feet of the North 100 feet of Lot 8 in
Surveyor's Plat No. 12 to the City of Salina,
Saline County, Kansas, containing 250 square feet,
more or less.
The above described tract (5 feet) lying West
of and immediately adjacent to the existing 35
foot right-of-way on the West side of Ohio Street,
which was acquired as follows:
Twenty feet dedicated for roadway
right-of-way as recorded in the office of the
Saline County Register of Deeds in Road Record
Book "C" page 141 and dated April 4, 1907; seven
feet acquired by condemnation for the widening of
Ohio Street as stated in Ordinance No. 3783,
passed on September 16, 1929; eight feet acquired
by Quit Claim Deed as recorded in the office of
the Saline County Register of Deeds in Deed Book
93, page 270 and dated May 29, 1930,
to the City of Salina, Kansas, and authorizing the
administrator to execute and deliver a good and sufficient
Permanent Easement conveying all of the interest of Alvin V.
Burkhardt in and to the above described real estate upon
full payment of the purchase price.
NOW, THEREFORE, the Grantor for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, does hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a the above described real estate owned by
the Grantor for all rights of ingress and egress of the
City, its servants, officers, employees, contractors, and
franchisees, for the purposes of installing, repairing,
replacing, and maintaining public utilities and public
sidewalk, in perpetuity.
IN WITNESS WHEREOF, the Grantor has signed this
