PERMANENT EASEMENT
THIS INDENTURE, made thi s 3rd day of Oct. ,
1988, by and between BERNIECE N. BACHOFER, a single person;
LOREN F. BACHOFER, a single person; NEIL V. BACHOFER and
PHYLLIS BACHOFER, husband and wife, and KAYE J. CRAWFORD and
LEROY H. CRAWFORD, wife and husband, (the "Grantors"), and
the CITY OF SALINA, KANSAS, a municipal corporation (the
"City").
WITNESSETH: The Grantors for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The West Five (5) feet of the East Forty (40)
feet of the North Fifty (50) feet of Lot Eight (8)
in Surveyor's Plat No. 12 to the City of Salina,
Saline County, Kansas, containing 250 square feet,
more or less.
The above described tract (5 feet) lying West
of and immediately adjacent to the existing 35
feet of right-of-way on the West side of Ohio
Street, which was acquired as follows:
Twenty (20) feet dedicated for roadway
right-of-way as recorded in the office of the
Saline County Register of'QØeds in Road Record
Book "C", page 141, and dated April 4, 1907; seven
(7) feet acquired by condemnation for the widening
of Ohio Street as stated in Ordinance No. 3783,
passed on September 16, 1929; eight (8) feet
acquired by Quit Claim as recorded in the office
of the Saline County Register of Deeds in Deed
Book 93, page 270, and dated May 29, 1930.
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.
