PERMANENT EASEMENT
THIS INDENTURE, made this 14th day of Sept. ,
1988, by and between WILLIAM W. SANDERSON and KAREN E.
SANDERSON, husband and wife, (the "Grantors"), and the CITY
OF SALINA, KANSAS, a municipal corporation (the "City").
WITNESSETH: The Grantors for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The West 5 feet of the East 40 feet
of the South 125 feet of the North 250 feet
of Lot 6 in Surveyor's Plat No. 12 to the
City of Salina, Saline County, Kansas,
containing 625 square feet, more or less,
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.
This permanent easement (5 feet) to lie West of and
immediately adjacent to the 35 feet of right-of-way on the
West side of Ohio Street, as described above.
IN WITNESS WHEREOF, the Grantors have signed this
Permanent Easement this 14th day of Sept. , 1988.

PARTIAL REAL ESTATE MORTGAGE RELEASE
The undersigned Mortgagee, pursuant to K.S.A. 58-2306,
acknowledges partial satisfaction of the debt secured by the
following described and recorded real estate mortgage (the
"Mortgage") and the same is hereby released in part as
follows:
1. The name of the Mortgagors are WILLIAM W.
SANDERSON and KAREN E. SANDERSON, husband and wife.
2. The name of the Mortgagee is PEOPLES HERITAGE
FEDERAL SAVINGS AND LOAN ASSOCIATION, formerly THE HOMESTEAD
SAVINGS AND LOAN ASSOCIATION.
3. The volume and page the Mortgage is recorded in
is: Book 290 of Mortgages, pages 309-310 of the records of
the Register of Deeds for Saline County, Kansas.
4. The Mortgage dated July 26, 1973, was recorded
August 10, 1973.
5. The legal description of that part of the property
subject to the Mortgage released by this partial release is:
The West 8 feet of the East 35 feet of the South
125 feet of the North 250 feet of Lot 6 in
Surveyor's Plat No. 12 to the City of Salina,
Saline County, Kansas; and,
The West 5 feet of the East 40 feet of the South
125 feet of the North 250 feet of Lot 6 in
Surveyor's Plat No. 12 to the City of Salina,
Saline County, Kansas.
6. This partial release shall not effect the lien of
the Mortgage as ~t applies to the remaining property
described in thè~Mortgage. ;

of Lot 6 in Surveyor1s Plat No. 12 to the City of Salina, Saline County, Kansas,
containing 1,000 Sq. Ft., more or less.
The above described tract (8 Ft.) lying West of and immediately adjacent to the
existing 27 Ft. of right~of-way on the West side of Ohio Street, which was
acquired as follows: '
20 Ft. dedicated for roadway right-of-way as recorded in the office of the Saline
County Register of Deeds in Road Record Book "C" page 141 and dated April 4, 1907;
7 Ft. acquired by condemnation for the widening of Ohio Street as stated in
Ordinance No. 3783, passed on September 16, 1929.
This conveyance will establish the West right-of-way line of Ohio Street as being
35 Ft. West of and parallel with the East line of the NE~ of Section 13,
Township 14 South, Range 3 West.
