PERMANENT EASEMENT
THIS INDENTURE, made this 6th day of Sept. ,
1988, by and between SALINA BOARD OF REALTORS, INC., (the
"Grantor"), and the CITY OF SALINA, KANSAS, a municipal
corporation (the "City").
WITNESSETH: The Grantor for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, does hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantor, more particularly described as follows:
The West Five (5) feet of the East Forty (40)
the North One Hundred Seventy-nine (179) feet
Two (2) in Surveyor's Plat No. 12 to the City
Salina, Saline County, Kansas, containing 895
feet, more or less.

for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.
IN WITNESS WHEREOF, the Grantor has hereunto caused
this easement to be signed on its behalf by its proper
officers who are duly authorized so to do and have caused
the common corporate seal to be hereunto affixed this 6th
day of Sept. , 1988.

Surveyor1s Plat No. 12 to the City of Salina, Saline County, Kansas,
containing 895 Sq. Ft., more or less.
The above described Tract (5 ft.) lying West of and immedi~tely adjaceG~-
to the existing 35 Ft. of right-of-way on the West side of Ohio Street,
which was acquired as follows:
20 Ft. dedicated for roadway right-of-way as recorded in the office of
the Saline County Register of Deeds in Road Record Book IICII page 141 and
dated April 4, 1907; 7 Ft. acquired by condemnation for the widening of
Ohio Street as stated in Ordinance No. 3783, passed on September 16, 1929;
8 Ft. acquired by Quit Claim as recorded in the office of the Saline
County Register of Deeds in Deed Book 93, page 271 and dated May 29,1930.
