EASEMENT
THIS INDENTURE, made this 25th day of February, 1953, by and
between THE SALINA BRICK & TILE COMPANY, a corporation, of the first part,
hereinafter referred to as Company, and the CITY OF SALINA, KANSAS, of
the second part, hereinafter referred to as City.
WHEREAS, the city, pursuant to the laws of the State of Kansas,
is engaged in the sale and distribution of water to its inhabitants as a
proprietory function; and
~~EREAS, company is the owner of that certain land hereinafter
described; and
vrrlEREAS, the city proposes to install certain water facilities
in that certain land hereinafter described; and
W}~, company, in consideration thereof, is willing to give
and donate that certain easement as hereinafter described unto the city;
and
SO, NOW, THEREFORE, company, for the consideration aforesaid, does
hereby grant, bargain, sell and convey unto the city an easement in, over
and across certain land owned in fee simple by said company, more particularly
described as follows, to-wit:
The South Thirty (30) feet of Lot Six (6) in Surveyor's
Plat Seven (7);
as filed of record in the Office of the Register of Deeds of Saline County,
Kansas, all for the right of ingress and egress by the city, its servants,
officers, employees and contractors, for the purpose of constructing,
maintaining, repairing and replacing water mains therein and thereon.
That upon the expiration of six (6) months from the date hereof,
the North Fifteen (15) feet of the easement aforesaid shall determine from
and thereafter, said easement shall subsist only as to the South Fifteen
(15) feet of said lot in said plat, as aforesaid.
After the installation, maintenance, repair and replacing from
time to time of said water main or mains, the city agrees to cause the
lands aforesaid to be restored to its original condition as near as that
is practical.
IN WITNESS WHEREOF, the company has hereunto caused this instrumen t
to be executed by its officers authorized so to do.

me, the undersigned, a Notary Public in and for the County and State aforesaid,
came T. J. Orrender, president of The Salina Brick & Tile Company, a
corporation duly organized, incorporated and existing under and by virtue
of the laws of Kansas, and 1linnie M. Orrender, secretary of said corporation,
who are personally known to me to be such officers, and who are personally
known to me to be the persons who executed, as such officers, the within
instrument of writing on behalf of said corporation, and such persons duly
acknowledged the execution of the same to be the act and deed of said
corporation.
