TI-iIS INDtNTUlŒ, made this 24th day of September, 19~4, by
and between the SAlINA BRICK ,?ë TILL~ COMPANY, a corporation, of the
firs t part, hereinafter referred to as "Company"; and the CITY OF
SALINA,t\ANSAS, of the second part, hereinafter referred to as "City".

WITNESSETH, that:
I'ÆEREAS, the Company is the owner of certain lands lying
within the City of Salina, Saline County, Kansas, described as follows,
to wi t:
All of Lots 1, 2, and 3 except the north 90 feet thereof,
and all of Lots 4 to 12, numbered consecutively inclusive;
all in Block 4, Stack Place, an Addition to said city; and
~~EREAS, the Company is about to sell and dispose of said
lands for the pur;:Jose of permitting the same to he developed as a resi-
dential area; and
~;1lLRl:;;AS, the City has required that an easement be dedicated
for utili~r installation and maintenance; and
5u, NO;:, TH£H1:.:F'OhE, Company, in considera t.ion of the City
authorizing the development of the lands for said purpose, does, hereby
grant, bargain, sell and convey unto the City an easement in, over, and
across certain portions of said lands, more particularly described as
follows, to wit:
The South Five (5) feet of Lots 1, 2, and 3;
the North Five (5) feet of Lot 4; and the
center ten (10) feet of Lots 4 to 12, numbered
consecutively inclusive, in said block.

That the easement aforesaid is hereby dedicated to the public
in perpetuity for the purpose of installing, maintaining, repaÜing,
and replacing from time to time water mains, sewer lines, electric and
gas facilities, and all other types of public utilities whether now in
general use or hereafter developed.
That the grant aforesaid and the dedication aforesaid shall
be permissive of the right of entry on the easement by the City, its
servants, officers, employees, and contractors, and servants, officers
and employees of any such contractors.
