PERMANENT EASEMENT
THIS INDENTURE, made this 6th day of Se¡Jt. ,
1988, by and between LOLA M. KOELLING, a widow; DUANE D.
KOELLING and KIM R. KOELLING, husband and wife; ARTHUR
R. KOELLING and LESLIE KAREN KOELLING, husband and wife;
RUTH LEANN HUTCHINSON and DAVID G. HUTCHINSON, wife and
husband; and EDWARD AARON KOELLING, a single person (the
"Grantors"), and the CITY OF SALINA, KANSAS, a municipal
corporation (the "City").
WITNESSETH: The Grantors for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The West Five (5) feet of Lot Eleven
(11), Block One (1), Stack Place Addition
to the City of Salina, Saline County, Kansas,
containing 225 square feet, more or less,
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.
IN WITNESS WHEREOF, the Grantors have signed this
Permanent Easement this 6th day of Sedt. ,1988.

AFFIDAVIT OF HEIRSHIP
STATE OF KANSAS, SALINE COUNTY, ss:
Lola M. Koelling, of lawful age, being first duly sworn
on oath states:
( 1) .
She is the surviving spouse of Aaron R. Koelling.
(2). Aaron R. Koelling died on March 4,1953, a
resident of Saline County, Kansas.
(3). No will of Aaron R. Koelling has been admitted to
probate nor was the estate administered.
(4). Aaron R. Koelling was survived by the following
named persons who are all of his heirs who would inherit
under the laws of intestate succession:
Lola M. Koelling, spouse
Duane D. Koelling, son
Arthur R. Koelling, son
Ruth Leann Koelling Hutchinson,
Edward Aaron Koelling, son
daughter
And further affiant says naught.
