KANSAS, a municipal corporation, Party of the Second Part, WITNESSETH:
That the said Party of the First Part for a good and valuable consideratiop receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and convey
unto said Party of the Second Part a 20' utility easement in, over and across a certain parcel of land

to the City of Salina, Saline County, Kansas used for utility easement purposes and more particularly

-thence N 00009'53"E, a distance of 10.00 feet to the Point of Beginning of the parcel to be

-thence S 89°50'07" E, a distance of20.00 feet;
-thence S 00°09'53" W, a distance of75.00 feet to the point of beginning.

For all of the rights of ingress and egress of the said Party of the Second Part, its servants, officers,
employees and contractors for the purpose of the construction, installation, repairing, replacing and
maintaining a utility easement in perpetuity.

That the said Party of the First Part for a good and valuable consideration receipt
and sufficiency of which is hereby acknowledged, do by these presents, grant, bargain,
sell and convey unto said Party of the Second Part storm water detention pond easement
in, over and across a certain tract of land owned by the Parties of the First Part more
particularly described as follows:
A parcel of land located in Lot 2, Block 1, Shoney's Addition, A Replat of a part
of Lot 1, Block 1, Sullivan Addition to the City of Salina, Saline County, Kansas used for
drainage easement purposes and described as follows:
Beginning at the Northwest corner of said Lot 2, Block 1;
-thence S 89 degrees 39' 12" E along the North line of said Lot 2 a distance of
295.00 feet;
-thence S 00 degrees 27' 12" W a distance of 150.00 feet;
-thence N 89 degrees 39' 12" W a distance of 295.00 feet to a point on the West
line of said Lot 2;
-thence N 00 degrees 27' 12" E along said West line a distance of 150.00 feet to
the point of beginning. Contains 1.02 acres (44,250 square feet) more or less.

All maintenance within the storm water detention pond easement shall be the right,
duty, and responsibility of Lighthouse Properties, LLC, their successors and assigns,
however, if maintenance is neglected or subject to other unusual circumstances and is
determined to be a hazard or threat to public safety by the Director of Engineering and
General Services, corrective maintenance may be performed by the City of Salina with
costs assessed to and born by said property owner. Officials representing the
Department of General Services shall have the right to enter upon the easement for
purpose of periodic inspection and/ or corrective maintenance of the drainage facility.
Prior to such inspections or maintenance the owner shall be given twenty four, (24)
hours notice unless an emergency exists. Upon receiving written approval from the
City Engineer, the owner of the property may construct improvements within the
easement, provided the improvement does not interfere with the function of the
detention facility. Also, upon receiving written approval from the City Engineer, the
owner may move or change the configuration of the pond and easement if deemed
necessary by future developments. Such approval by the City Engineer shall not be
unreasonably withheld.
