EASEMENT
This Indenture, made this 5th day of December, 19 72 ,
by and between HARRY O. SINSABAUGH and MILDRED E. SINSABAUGH, hus-
band and wife, Parties of the First Part and THE CI'l'Y OF SALINA,
KANSAS, a municipal corporation, Party of the Second Part, WITNESSETH:
That the said Parties of the' First' Part for a good and valuable
consideration receipt and sufficiency of which is hereby acknowledged,
do by these presents grant, bargain, sell and convey unto said Party
of the Second Part an easement in, over and across a certain tract of
land owned by the Parties of the First Part more particularly des-
cribed as follows:

Beginning at a point that is ten feet (10') north
of the southeast çorner of Lot One (1), Block Six (6),
Rolling Hills Addition to the City of Salina, Kansas;
thence west one hundred ten feet (110') to a point ten
feet (10') north of the southwest corner of said Lot
One (1); thence north five feet (5') along the west
line of said Lot One (1); thence east one hundred ten
feet (110') to the east line of said Lot One (1);
thence south ,five feet (5') to the point of beginning;
and

Beginning at a point that is ten feet (10') north
of the south east corner of Lot Thirteen (13), Block
Six (6), Rolling Hills Addition to the City of Salina,
Kansas; thence west one hundred ten feet (110') to a
point ten feet (10') north of the southwest 02nsr of
said Lot Thirteen (13); thence north five feet (5')
along the west line of said Lot Thirteen (13); thence
east one hundred ten feet (110') to the east line of
said Lot Thirteen (13); thence south five feet (5')
to the point of beginning;
for all of the rights of ingress and egress of the said Party of the
Second Part, its servants, officers, employees and contractors for
the purpose of constructing, installing, repairing, replacing and
maintaining a sewer line or any other utilities, in perpetuity.

and THE CITY OF SÞ.LINA, KAnSAS I a municipal corporation, party of
the second part
WITNESSETH, in consideration of the sum of One Dollar and
other valuable consideration, the receipt whereof is hereby acknow-
ledged, the parties of the first part do hereby sell, grant and
convey to the party of the second part an easement for the purposes
hereinafter set forth in and to the followinq described real estate
situated in the County of Saline, State of Kãnsas, to-wit:

Beginning at a point that is the southeast corner
of Lot 1, Block 6, Rolling Hills Addition to the City
of Salina, Kansas; thence west one hundred ten feet
(110') to the southwest corner of said Lot 1; thence
north ten feet (10') along the west line of said Lot
1; thence east one hundred ten feet (110') to the east
line of said Lot 1; thence south ten feet (10') to the
pant of beginning; and
Beginning~ a point that is the southeast corner
v of Lot 13, Block 6, Rolling Hills Addition to the. City
of Salina, Kansas; thence west one hundred ten feet
(110') to the southwest corner of said Lot 13; thence
north ten feet (10') along the west line of said Lot
13; thence east one hundred ten feet (110') to the
east line of said Lot 13; thence south ten feet (10')
to the point of beginning.
An easement in said real estate is hereby granted and conveyed
to party of the second part for the purpose of laying out, relocat-
ing, altering, widening, constructing and maintaining a road or
street in the City of Salina, Kansas for as long as said real estate
is required and used for said purposes, or any of them, by party of
the second part; the grant of said easement is made upon the express
conditions that if said road or street, the right-of-way for which
said real estate is now acquired by party of the second part, are
hereafter abandoned and vacated, all of th~ right, title and inter-
est; of party of the second part in and to the above described real
estate by virtue of this instrument shall cease and determine and
the same shall revBrt to parties of the first part, his or their
grantees, heirs, successors or assigns.
Parties of the first part do hereby agree that the. considera-
tion expressed herein and the benefits to accrue to parties of the
first part from the laying out, relocating, altering, widening, con--
structing and maintaining of said road is in full and complete sat-
isfaction for said right-of-way eas~ment, and all damages to parties
of ele first part which may arise from the use of said real estate
for the purposes herein set forth.
Said first parties do hereby covenant with party of the second
part that at the delivery of these presents they are seized of an
absolute and indefeasible astate of inheritance in fee simple of the
above described real estate and that the same is free and clear of
encumbrances.
