CONVEYANCE OF EASEMENT

THIS INDENTURE, HADE THIS ð - day of March, 1964, by and
between THOMAS D. DEARING, a single person, of Salina, Kansas, of
the first part, and THE CITY OF SALINA, KANSAS, of the second part"
and,
WHEREAS, party of the second part desires to obtain an ease
ment over, upon and through certain land owned by the party of the
first part as hereinafter described; and,
WHEREAS, the party of the first part is the owner in fee si -
pIe of said land and is willing to grant said second party said
easement; and,
SO NOW, THEREFORE, WITNESSETH:
That the party of the first part, in the consideration of
the sum of One Dollar ($1.00) and other good and valuable consider
ation, receipt of which is hereby acknowledged, do by these prese t,
grant, bargain, sell and convey unto second party an easement in,
over and across a certain portion of land owned by party of the
first part, more particularly described as follows:
A tract of land in Block 3, Lot 9, Riverview
more particularly described as follows:
liddition,
Beginning at the Northwest Corner of Lot Ten (10),
Block Three (3), said point being on the East Line
of Lot Nine (9), Thence Northwesterly a distance of
Sixty-three (63) Feet, more or less, to the Northwest
Corner of Lot Nine (9); Thence East along the West
Line of Lot Nine (9) a distance of Thirty (30) Feet
to the Northeast Corner of Lot Nine (9); Thence North-
easterly a distance of Forty-three (43) Feet, more or
less, along the Northeast Line of Lot Nine (9) to
the point of beginning~
for all the rights of ingress and egress of second party, its ser-
vants, officers, employees and contractors for the purpose of con-
structing, installing, repairing, replacing and maintaining a publ c
street and any public utilities and any other appurtenances theret
in perpetuity.
