BACKGROUND: A preliminary development plan/plat application for Highland Meadows Hamlet was approved by the City Planning Commission on May 2, 1995. Companion rezoning and annexation applications were also recommended for approval and the recommendation on zoning was for R (Single-Family Residential) and R-2 (Multi-Family Residential) as the underlying zoning for the subdivision. The City Commission approved an ordinance rezoning this tract to POD Rand R-2 and a final plat for Phase I on October 16, 1995. The applicant's preliminary development plan/plat was approved subject to the following nine (9) conditions and corrections: 1. Development limitations shall be as follows: a. Lots 1-18, Block 3, shall be limited to the uses permitted and the lot size and bulk regulations specified in the R-2 Multi-Family Residential District. Development shall be limited to 18 single-family attached dwellings containing not more than 2 units per building. b. All other lots shall be subject to the permitted uses, lot size and bulk regulations specified in the R Single-Family Residential District. 2. A final plat shall be submitted and approved prior to final approval of the preliminary planned development district. 3. The City Engineer shall approve plans and specifications for storm water collection, water and sanitary sewer systems prior to consideration of a final plat for the development. 4. The developer shall install or sufficient financial guarantees shall be in place to provide for the installation of all of the following facilities and improvements: streets, ditches, water systems, sanitary sewer facilities and pedestrian-ways prior to consideration of a final plat for the development. 5. The City Engineer shall certify that adequate water supply exists to meet minimum fire-flow requirements for all proposed building lots or the owner shall comply with applicable exemption criteria prior to issuance of any building permit. 6. No development shall occur in Phase II of the subdivision until a second entrance on Magnolia Road is opened and a second connection to the Magnolia/Markley Road water line is installed. The applicant shall submit legal assurances to the City consenting to the establishment of a special assessment district and obligating the abutting land within the proposed development for one-half of the total cost to reconstruct two lanes on Magnolia Road to city residential street standards. Said assurance shall be valid for a 10 year period and legally binding on existing and future owners of land within the development. This covenant shall be recorded with the final plat. 8. A note shall be added to the preliminary development plan as follows: "Maintenance of streets, the common area and other open space areas delineated on the development plan will be the responsibility of the Highland Meadows Hamlet Homeowner's Association. 9. The applicant shall submit a revised preliminary development plan containing all corrections noted by staff prior to consideration by the City Commission. Conditions #1, 2, 8 and 9 related to the POD zoning of this property and Conditions #4 and 7 were satisfactorily addressed by the applicant. Condition #6 related to future development phases and was an expression of concern about how many homes or homesites could safely be served by a single access point in to the subdivision and how far south development could go from Magnolia Road and still maintain flows of at least 1 ,000 gpm in the public water system. In 1990, the developer determined that the market for two-family homes (townhomes) in his subdivision was not as strong as he originally anticipated and he filed a request to downzone 14 of the 18 lots in Block 3 from R-2 to R in order to convert them to single-family homesites. This effectively reduced the number of housing units to be served by one entry way by 14 and also reduced the potential demand on the water distribution network in Phase I. As a result of this downzoning, staff believes that Condition # 6 is less important than it was when 84 housing units were originally proposed in Phase I. Nature of Current Reauest The applicant is requesting final plat approval for a 17 acre tract bordered by the Smoky Hill River on the west, the first phase of Highland Meadows Hamlet on the north and pasture land on the east and on the south. The 17 acre tract would be subdivided into 24 residential buildings. The 180 acres directly east of this tract is also owned by the applicant but is not slated for development in the near future. The 17 acre tract now being proposed for residential development is vacant and used for agricultural purposes. This would not be a freestanding subdivision but would be an extension of the original Highland Meadows Hamlet Addition. Lot buyers would be part of the same association and subject to the same covenants as owners in the first phase. Subdivision Desian The final plat drawing submitted for Phase II (Highland Meadows Hamlet Woodlands) appears to be in substantial conformance with the approved preliminary plat. The area covered by this final plat is 17 acres and 24 building lots are proposed. There are 66 lots in Phase I. However, Block 2 on the original preliminary plat submission was bisected by the final plat boundary so the lot and block numbering system in Phase II reflects that these are now separate subdivisions. The slopes on this 17 acre property are not so severe as to make any portion unbuildable. It appears that the applicant has designed a street system and lot layout that conforms with and utilizes the existing topography, meaning that no massive grading or regrading of the site proposed. All lots shown in Phase II would have adequate frontage on and access to a private street. It appears that the width, depth and area dimensions of all lots shown on the plat would far exceed the minimum standards of the R district. It does not appear that there would be any foreseeable difficulties, for reasons of topography or other conditions, in obtaining building permits to build on any of the proposed lots. The only access to the Highland Meadows Hamlet development is a private street (St. Andrews) that serves as a collector and connects with Magnolia about halfway between the river channel and Markley Road. There is a divided entryway at the intersection and this section of St. Andrews is wider than a standard residential street. All internal streets in Phase I are privately owned and maintained by a homeowners association. This would apply to Phase II as well. St. Andrews serves as a collector for Highland Meadows Hamlet and two residential streets (Angus and Dundee) provide access south from St. Andrews into the remainder of the development. The proposed right-of-way for streets in Phase II is 60 ft. with 29 ft. of paving. Because all proposed streets are private, the "right-of-way" would actually be common area owned by the Highland Meadows Hamlet Homeowners Association. In lieu of sidewalks, the developer proposed a series of 40' wide pedestrian pathways or corridors located in the rear of lots along the eastern and southern edge of the platted area including the rear of the lots on the south side of Aberdeen Lane in Phase II. Subdivision Improvements 1. Water- The Markley Tower supply line runs along the south side of Magnolia adjacent to Highland Meadows Hamlet. Given the size of this line (12") and the elevation of the Markley Tower (1467') there is adequate water volume and pressure to meet the domestic needs of the residential development proposed within the final plat boundary. The volume available for fire protection is more marginal according to the Utilities Director. The Utilities Director indicates that the existing network of looped 6" lines is capable of providing adequate fire flows (1 ,000 gpm) in Phase I. Due to elevation and friction loss those flows should be expected to drop slightly in Phase II. The existing water line system consists of a 6" main connected to the 12" Magnolia line at St. Andrews with a second connection, a 6" main just north of the Glencoe cul-de-sac. A network of 6" mains was installed within the private street right-of-way in the subdivision and this system will be extended to serve Phase II and looped at the intersection of Aberdeen Lane and CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 6/27/2005 TIME 4:00 P.M. Sanitary Sewer - The city's southeast sewer interceptor runs along the north side of Magnolia opposite Highland Meadows Hamlet. A pump station was constructed adjacent to St. Andrews at the north end of the subdivision near Magnolia Road and individual lateral lines gravity flow from south to north into the pump station. The effluent is then pumped under pressure into the 24" interceptor which is a force main in that location. As in Phase I, all internal sewer lines in Phase II would be public lines. Long term, the City's Utilities Division would like to see a new pump station located and designed to accommodate future development north of Magnolia both east and west of Markley Road. The Highland Meadows pump station is considered "temporary" . 3. Storm Drainage - The City's stormwater management regulations require developers to design a stormwater drainage system to either accommodate or detain the additional runoff caused by development of the site (the difference between existing and developed conditions). Because the Smoky Hill River is available as a discharge point for stormwater runoff, no stormwater detention system was determined to be needed for Phases I and II of this development. The primary difference between Phases I and II is that in Phase I the drainage collection system consisted of roadside ditches and swales and in Phase II the use of curb and gutter and inlets and pipelines is proposed. 4. Easements and Dedications - The applicant is proposing to dedicate all utility lines to the City for public maintenance. All road right-of-way would be private common area but would also serve as a utility easement for public utilities (water, sewer & gas). All utility easements shown on the plat would be dedicated public easements. All utility services are underground in Phase I. The applicant is proposing underground electrical service within Phase II as well. The Phase II area is currently within the OS & 0 Rural Electric Cooperative service territory because it has not been annexed into the city. Phasina of Public Improvements The applicant plans to construct the public improvements for all 24 lots at one time. Special Assessments As this property is currently outside the City's Primary Growth Area it is not eligible for special assessment financing for public improvements. Because the proposed streets would be private, only the water and sewer lines serving this subdivision would be considered public improvements. The applicant has indicated that the installation of all improvements (public and private) would be financed privately. CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 6/27/2005 TIME 4:00 P.M. Covenants and an architectural control committee were used to establish private housing design requirements and other building restrictions and to provide for maintenance and upkeep of the common area in Phase I. The City's only enforcement role would be in the event of a default on the maintenance of the common area such as the private streets. Lot buyers in Highland Meadows Hamlet Woodlands would be subject to the same covenants and part of the same homeowners association as the lot owners in Phase I. Relationship to the Comprehensive Plan Service Areas Map - The City's Services Area Map shows this area as a Secondary Growth Area for urban development. Land Use Map - The City's Land Use Plan shows this area as appropriate for low density residential development. Plannina Commission Action The Planning Commission reviewed the proposed final plat of this 17 acre parcel at its June 7, 2005 meeting. The Planning Commission voted 7-0 to approve the proposed final plat of Highland Meadows Hamlet Woodlands subject to the following conditions: 1. A temporary roadway easement shall be provided and a temporary cul-de-sac with a turning radius of at least 40 ft. shall be constructed at the eastern terminus of Aberdeen Lane. 2. Final engineering design plans, for street and utility extensions, must be approved by the City Engineer prior to beginning construction of any public improvements on the property. 3. A Certificate of Completion for all public improvements installed on the property must be issued by the City Engineer prior to issuance of any building permits in Phase II. 4. The Director of Utilities shall certify that adequate water supply exists to meet minimum fire-flow requirements for all proposed building lots in Phase II or the owner shall comply with applicable exemption criteria prior to issuance of any building permits in Phase II. 5. Any platting beyond the boundaries of the Highland Meadows Hamlet and Highland Meadows Hamlet Woodlands Additions shall include a second street connection to Magnolia Road. Mr. Andrew presented a combined staff report on all 3 applications. He stated / that Mr. Johnson has some additional staff comments. Mr. Johnson stated just a couple quick comments if I may. In conversations with the Utilities Director we had recently tested fire flows on a couple of existing hydrants in the Phase I area and it was very questionable as to whether the 1,000 gallons per minute for Phase I would be sufficient for this phase but we would certainly like to work with the applicant's engineer on some creative ways to maybe look at alternate designs for that to. try to achieve that 1 ,000 gallons per minute. I am not exactJy sure where all the hydrants were just north in the existing subdivision. In just looking at that la~t week we have some Utilities Director questions about being able to achieve 1,000 gallons per minute. The other thing I would just throw out is that as I looked at the drainage system for this area one of the things that is of concern to me, not that it can't be overcome, but as we are looking at the pipeline sizes and those types of things to make sure that we are accommodating potential flow from the east. As Dean mentioned there is quite a bit of terrain from the east to west. I believe that unless there's some reason to go around this phase of the subdivision we are going to be bringing water at some point through this area of the subdivision. We would certainly work with the design engineer for the subdivision on that and in terms of the infrastructure, we do have a set of concepts, preliminary concepts for infrastructure we have had a chance to review but have not developed comments on those yet. But we are very close to being able to do that. That is the only comment that I have. Just to kind .of get your bearings a Uttle bit this is approximately where Markley comes in. This is Magnolia Raad. This is Holmes Road aver here so we are focusing on Phase I and II initially. This area that Brad is speaking ta is that the cantaurs here shaw the high point .of this property. It has ~ kind of a ridge here. Mr. Funk asked haw far is it from Magnolia ta the sauth~rn most lot, is that ~ mile? Mr. Andrew stated I believe that's correct but the applicant wauld prabably have better infannation on that. Mr. Funk asked what wauld trigger then the required secand entrance .or entry off of Magnolia? Mr Andrew stated none .of this area has been preliminary platted. This is a cancept plan for the benefit of the Planning Commission and staff. So the message that you could send is if you come in for the next phase of platting that phase will need to include a tie back to Magnolia Road at some location so it would be don"e through the platting process. Mr. Simpson stated alright any further questions at this point for the staff? Would the applicant or his representative address the Commission. Mr. Norton? Chairman and gentleman, my name is Frank Norton, 2524 East Magnolia Road and of course the report is very comprehensive and as to the specific things that were mentioned of caurse we are going to comply with whatever the requirements are, whatever the mast desirable plan is. First of all water pressure, excessive pressure has been a problem for us. Every home out there has a limit control so as to cut down the amaunt of pressure coming into the home. The reason for that as I understand it is the wat~_r tower off Markley Road up in the East Crawford Recreation Area has enough height that when the water flows dawn that area it comes with some pressure. There is presently a loop, and I am not sure the size of it, that connects the main east-west water line aJong Magnolia with the development One at the entrance at St. Andrews, the other just a little bit west of that and J sure that is just for temporary use. But there is a present loop in that connection so whatever the requirements or desirability is concerning the water pressure we will of course comply with that. We are very sensi~ive about the surface water situation there. We recognize that where it is we have a number of ways of handling it. We've talked with the / engineers about that. They've proposed some tube type areas that will tube the water from where" it's received now to where we are converting fram ditches to curb and guttering on over to areas where they will drain off and ultimately drain into the river so that's certainly something we are sensitive to and we will want to comply fully with that. The distance to answer the question as to the distance from Magnolia ta the south property line, it's a half a mile. As to any of the other matters I think I will just kind of open myself to questions if you have any as to any of the other features of it. Mr. Simpson asked are there any questions of Mr. Norton? Mr. Norton stated we have a representative of the engineer firm that is doing all the technical work. If you would like to have him cover any of this, we would be happy to da that. Whatever it is we are gaing to cooperate fully in getting it done. The only thing is we do not want to gravel the radius that Dean was talking about. We plan to use asphalt millings. Mr. Ramage stated what are millings? Mr. Norton stated millings are the fine material that they grind off of the asphalt highways and so forth and they usually mix it in with new hot mix. Mr. Simpson stated that's better than gravel, yeah. Salina Planning Commission June 7, 2005 Page 24 Mr. Andrew stated what we are saying is that we are not going to set the standard for that. Mr. Norton can set the standard for that turnaround we are not going to expect it to have a base under it and all that you would have with a street because it is temporary. Mr. Norton stated the only other thing I guess is when another entry is called for as suggested our present plan is to come off at Markley and Magnolia and go south to St. Andrews but that's in the future. Mr. Simpson asked would anyone else care to address this application? Apparently not. The only item we had recommended conditions on would be the final plat where we had some recommended conditions relating to getting certification from the Director of Utilities about the water supply, the second street connection and about having final engineering design plans approvedr but the zoning, the plat and the annexation would be three separate actions. Mr. Andrew stated the good news is that, and we may work on a one hour study session for the 21st of June, but we have no business items scheduled. We will try to get something prepared for that date that will be limited to one hour and the good news is that on July 5th we have no items scheduled so there will be no meeting on that day at all. 'think we will make up for it on the 19th of July. If you are familiar with the property, actually Mr. Norton owned it and sold it, but it's at the northeast corner of Markley and Magnolia. It is north of the church and west of the church there. We have a proposal for a residential subdivision in that area and we will be coming forward with zoning, platting and annexation, well actually it's already annexed into the city, but zoning and platting of that property and then we are expecting the replat for the Salina Regional Health Center will be ready for consideration then as well. So no regular agenda for the 21st and no meeting at all on the 5th and we are going to try to come up with a one hour study session for the 21 st. Mr. Ramage asked what will we be studying? Mr. Andrew stated I think just a little bit on terminology. Focus that on some of the technical things. Just to kind slow down on some of the vocabulary that you hear from planners and engineers and talk a little about easements and common area those types of things and just kind of focus on terms and those kind of technical things that we throw around at meetings just to try to make sure that from a definitional standpoint that we are on the same page because I know we use a lot of terminology in our reports and other things we ~C?nlt give much background on. So I think it will focus on that. We rrl"ight have some graphic examples for you and limit that to one hour but I think the next meeting with any kind of regular agenda items will be the 19th of July.
