UTILITY EASEMENT

CITY OF WICHITA, KANSAS, a municipal corporation, with principal offices at Wichita,
Sedgwick County, Kansas, Party of the First Part and THE CITY OF SALINA, KANSAS, a
municipal corporation, Party of the Second Part, WITNESSETH:
That the said Party of the First Part for a good and valuable consideration receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and
convey unto said Party of the Second Part a non-exclusive easement in, over and across certain
portions ofland owned by the First Party, more particularly described as follows:
Easement No. One:
A tract ofland five feet (5.00') either side of the following described line located in the Replat of
Lot One (1), Block One (1), Salina Presbyterian Manor Inc. Subdivision to the City of Salina,
Saline County, Kansas described as follows:
Line Description:
Commencing at the Southwest Corner of said Lot One (1), thence easterly along the south
boundary line of said Lot (1) on the platted bearing of North 89 degrees 20 minutes 30 seconds
East a distance of Three Hundred Ninety-four and Seventy-eight hundredths feet (394.78') to the
point of beginning;
Thence North 00 degrees 00 minutes 00 seconds East a distance of Eighty and Ninety-seven
hundredths feet (80.97');
Thence North 06 degrees 20 minutes 58 seconds East a distance of Two Hundred Sixty-six and
Thirty-eight hundredths feet (266.38');

Thence northeasterly along the arc of said non-tangent curve, and curve having a chord bearing
North 46 degrees 29 minutes 32 seconds East, a chord distance of One Hundred Sixty-one and
Sixty-six hundredths feet (161.66') and a central angle of36 degrees 35 minutes 24 seconds, a
distance of One hundred Sixty-four and Forty-four hundredths feet (164.44') to a reverse curve to
the left;
Thence northeasterly along the arc of said reverse curve, said curve having a cord bearing North

Commencing at the Northwest Corner of said Lot One (1), thence easterly along the north
boundary line of said Lot One (1) on the platted bearing of North 89 degrees 21 minutes 18
seconds East a distance ofTen feet (10.00') to the point of beginning;
Thence South 00 degrees 00 minutes 00 seconds East and parallel with the west line of said Lot
One (1) a distance of Four Hundred Ninety-nine and Fifty-five hundredths feet (499.55').
Thence South 47 degrees 46 minutes 48 seconds East a distance of Five Hundred Eighty-three
and Seventy-one hundredths feet (583.71').
The above described tract of land contains 21,665 square feet more or less.
F or all of the rights of ingress and egress of the said Second Party, its servants, officers,
employees and contractors for the purpose of the constructing, repairing, replacing and
maintaining a public waterman in perpetuity.
The City of Salina, Kansas, will at all times repair any damage to: (i) the land and
improvements thereon within the easement areas; (ii) the surrounding property owned by the City
of Wichita, Kansas; and (iii) property owned by third parties, to its condition immediately prior
to such damage if such damage is caused by the construction, repair, modification, replacement,
or other activity by the City of Salina, Kansas, or its agents, contractors and employees in, upon
or under the easement areas, or the failure ofthe water main(s) located in, upon, or under the
easement areas.
