PERMANENT EASEMENT
THIS INDENTURE, made this 7th day of Se~t.
1988, by and between JACK O. BAUGHMAN and ADELINE M.
BAUGHMAN, husband and wife, (the "Grantors"), and the CITY
OF SALINA, KANSAS, a municipal corporation (the "City").
WITNESSETH: The Grantors for a good and valuable
consideration, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant, bargain, sell, and
convey unto the City, a permanent easement in, through,
over, and across a certain portion of land owned by the
Grantors, more particularly described as follows:
The East Five (5) feet of the following described
property: That part of Block Two (2), Phillips East
Salina Addition to the City of Salina, Saline County,
Kansas, and that part of vacated Stapler Avenue,
described as follows:
Beginning at a point on Gypsum Avenue One Hundred
Ninety-six (196) feet South and One Hundred Forty-six
(146) feet East of the Southwest corner of Lot Nine
(9), Block One (1), Phillips East Salina Addition;
thence North and parallel with the East line of Oakdale
Addition One Hundred Forty-six (146) feet; thence East
Fifty (50) feet; thence South along the West line of
Ohio Street One Hundred Forty-six (146) feet; thence
West along the North line of Gypsum Avenue Fifty (50)
feet to the point of beginning.
for all rights of ingress and egress of the City, its
servants, officers, employees, contractors, and franchisees,
for the purposes of installing, repairing, replacing, and
maintaining public utilities and public sidewalk, in
perpetuity.
IN WITNESS WHEREOF, the Grantors have signed this
Permanent Easement this 7th day of Sept. , 1988.
