RIGHT-OF-WAY EASEMENT
This Indenture, made this -.;2.q~ day of February.. 1984, by
and between IDUIS J. WAGNER and. j~JYrJ... 5 WAGl\JER, his wife;
and BRUCE A. THCMSCN and bl;4.~'\h ß. THCMSON, his wife, herein-
after referred to as the "Parties of the First Part", and the CITY
OF SALINA, KANSAS, a municipal corporation, hereinafter referred
to as the "Party of the Second Part", WITNESSETH:
That the Parties of the First Part, for a good and valuable
consideration, the receipt and sufficiency of which is hereby acknow-
ledged, do by these presents grant, bargain, sell and convey unto
the said Party of the Second Part a pe.rman.ent easement in, over and
across a certain tract of land owned by the Parties of the First Part,
ITDre particularly described as follows:
A tract of land in Lot 109 on 4th Street, Original
Townsite, City of Salina, Saline County, Kansas, being
more particularly described as follows: Beginning at
a point on the north line of said Lot 109 that is 105. 00
ft. west of the N.E. COTI1er of said Lot 109; thence
SOoOO'Wa distance of 5.00 ft.; thence N90o00'W a
distance of 8.90 ft.; thence N12°23'W a distance of
5.12 ft. to the north line of said Lot 109; thence
S90o00'E along the north line of said Lot 109 a
distance of 10.00 ft. to the point of beginning.
Said tract contains 47 sq. ft., ITDre or less,
for all of the rights of ingress and egress of the said Party of
the Second Part, its servants, officers, employees and contractors
for the purpose of construction, installing, repairing, replacing
and maintaining a public street in connection therewith, in perpetuity.
IN WITNESS WHEREOF, the said Parties of the First Part have
unto set their hands the day and year first above written.
