UTILITY EASEMENT
This Indenture, made this LM.day of July, 2000, by and between THE ST. FRANCIS
ACADEMY, INC., a Kansas cbrporation, Party of the First Part and THE CITY OF SALINA,
KANSAS, a municipal corporation, Party of the Second Part, WITNESSETH:
That the said Party of the First Part for a good and valuable consideration receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and
convey unto said Party of the Second Part a utility easement in, over and across a certain
parcel of land located in Lot 41 on Second Street and Lot 21 on Front Street, Original
Townsite, City of Salina, Saline County, Kansas, more particularly described as follows:
Beginning at a point on the west line of said Lot 41 that is 5 feet south of the
northwest corner of said Lot 41; thence east along a line that is parallel with the
north line of said Lot 41 and said Lot 21 a distance of 250 feet to a point on the east
line of said Lot 21 that is 5 feet south of the northeast corner of said Lot 21; thence
south along the east line of said Lot 21 a distance of 20 feet; thence west along a
line parallel with the north line of said Lot 21 and said Lot 41 a distance of 250 feet
to the west line of said Lot 41; thence north along the west line of said Lot 41 a
distance of 20 feet to the point of beginning. Said tract contains 0.11 acres more
or less.
For all of the rights of ingress and egress of the said Party of the Second Part, its servants,
officers, employees and contractors for the purpose of the construction, installation,
repairing, replacing and maintaining a public sanitary sewer system.
