CONVEYA:;NCE OF EASEHENT
TIlI:> INDENTURE, made this ;J.../ day of' January, 1966, by and
between Verne L. Rhodenbaugh and !~ry Jo Rhodenbaugh, parties of
the first part, and the CITY OF SALINA, KANSAS of the second part.
WlfERBAS, party of' the second part desires to obtain an easement
over, upon and through certain land owned by f'irst parties, as
hereinaf'ter described; and
"mEF.EAS, the parties of the first part are 'Willing ~o grant
said second parties said 'easement; and
SO, NOW, TfŒREFORE, ~ITTNESSETH:
That the parties of the first part, in consideration of the
payment of' the sum of' One Dollar and other good and valuable con-
sideration, receipt of which is hereby ackno,ùedged, do by these
presents grant, bargain, sell and convey untC) second parties an
easement in, over and across a certain portion of the land owned
by first parties, more particularly described as follows, to-wit:
A parcel of land located in parts of Lots 4
and 5, Block 6, Morningside Addition to the
City of' Salina, Kansas, more particularly de-
scribed as f'ollows:
Beginning at a point 25 feet north and
f'ive (5} feet west of the southwest corner of
said Lot 5;
TIlcncc northeasterly to a point 20 feet
east o~ the west line of said Lot 5;
Thence due east a distance of 11 feet
more or less to a Doint measured 10 feet
perpendicular to the last described line;
Thence south~rosterly to a point five (5)
feet north and 't'Test of the ~'i'Cst line of Lot 5,
Block 6, Eorningside Addition;
Thence North to the point of beginning;
all f'or the right of ingress and egress by second party, its servants.
officers, e~ployeos and contractors, for the purpose of installing,
maintaining, replacing and repairing lateral sanitary sewers, and all
colli~ections, mar~ole$, flush tanks and other appurte~~nces the~eto,
all in accorciance vdth the plans and specifications DOTIl on file in
the office of the City Clerk of the City of Salina, l~nsas, which
plans and specifications are made a part hereof' by reference.
The foregoing shall be construed to be a covenant running with
the land.
