(formerly known as Planters Bank and Trust Company of Salina, Kansas), Trustee under trust agreements establishing the William H. Graves Realty Trust, the Lowell P. Graves Realty Trust, the John A. Graves Family Trust, and the Dwight L. Graves Trusts, fee owner of Mariposa (Blocks 1 through 6), a subdivision of the City of Salina, County of Saline, Kansas, the recorded plat of which was filed for record in the office of the Register of Deeds on April 26, 1989 at 2:55 p.m. and there recorded in Plat Book Volume A-8 at page 25, for good and valuable consideration, DOES HEREBY GRANT AND CONVEY UNTO THE CITY OF SALINA AND MARIPOSA HOMEOWNERS ASSOCIATION (a not- for-profit Kansas corporation) AN EASEMENT on and over the following real estate: Lot 12, Block 1 of Mariposa (Blocks 1 through 6), a subdivision of the City of Salina, located in Saline County, Kansas, exclusive of the EAST 300 feet thereof, to construct, maintain, and operate a primary storm water runoff detention structure upon said Lot 12, including, but not limited to, an earthen dam, an inlet orifice structure with trash racks, and elliptical corrugated metal pipe, an outlet channel and spillway, and concrete erosion control structures, which improvements confer a special benefit upon Mariposa (Blocks 1 through 6), a subdivision of the City of Salina. Said improvements shall be maintained pursuant to "Restrictive Covenants (To Maintain Storm Water Detention Structure)" dated March 1,1990 and recorded with the office of the Register of Deeds of Saline County, Kansas contemporaneously herewith. This instrument shall not be amended or modified in any manner without the prior approval of the Planning Commission and governing body of the City of Salina, Saline County, Kansas.
