THIS AGREEMENT made this::> day of December, 2000 by and between Faith Assembly of God, Inc. hereinafter referred to as "Grantor", and Anna Marie Moser hereinafter referred to as "Grantee" RECITALS WHEREAS, Grantor is the owner of certain real property hereinafter referred to as the servient tenement, and more particularly described as follows: Legal Description: The West ~ of Lot 8 and the West ~ of the East ~ of Lot 8, Block 1, Lamer's 15\ fl..rJrJi'llcJri to the City of Salina, Saline Co., Kansas. Subdivision WHEREAS, Grantee is the owner of real property hereinafter referred to as the dominant tenement, and more particularly described as follows: Legal Description: The East 45' of the West 95' of the East ~ of Lot 3, Block 1, Lamer's 15t f!/.rJeJiØØrj to the City of Salina, Saline Co., Kansas. Subdivision WHEREAS, Grantee desires to acquire certain rights in the servient tenement and the Grantor is agreeable to granting certain rights in the servient tenant to the Grantee. The parties hereto therefore agree as follows: 1. For valuable consideration, the receipt of which is hereby acknowledged, Grantor hereby grants to Grantee an easement or right to install, repair, maintain, alter, reinstall, and utilize a private sanitary sewer line in, into, upon, over, across and under a strip of land on the servient tenement not to exceed 20' in width, being the West 10' of the West ~ of the East ~ and the East 10' of the West ~ of Lot 8, Block 1, Lamers 15t !f.c)c)iMrJ. to the City of Salina, Saline Co., Kansas. Subdivision 2. The easement herein granted is appurtenant to and shall run with the dominant tenement to the benefit of the parties hereto, and their respective heirs, personal representatives, successors, and assigns. 3. The sanitary sewer line installed in said easement shall be owned by the Grantor. However, the Grantee agrees to bear their proportionate share of any costs and expenses relating to the repair, maintenance, or reinstallation of the sewer line in a proper, substantial and workmanlike manner. 4. It is expressly understood and agreed that Grantee shall have the right of ingress to and egress from the servient tenement for the purpose of maintaining, repairing, and keeping the joint use sewer line in usable condition at all reasonable times.
