DRAINAGE EASEMENT

This Indenture, made this 1(, - day of J¡j-¡£/(..( 11-!2-- r , 1995, by and between
Lakewood Townhouses, LTD, of 1310 E. North, Box 1884, Topeka, Kansas" 66601, Party of the First
part and City of Salina, Kansas, Party of the Second part, WITNESSETH:
That the said Party of the First part for a good and valuable consideration receipt and sufficiency
of which is hereby acknowledged, do by these presents, grant, bargain, sell and convey unto said Party of
the Second part an easement in, over and across a certain tract of land owned by the Party of the First part
more particularly described as follows:
A tract of land which is part of the Lakewood Townhouse property situated in the
Southwest 1/4 of Section 7, Township 14 south, Range 2 West of Sixth Principal
Meridian, Saline County, Kansas, more particularly described as follows:
Commencing at the West Quarter Corner of said Section 7; thence on a magnetic
bearing ofN 81° 12' 47" E along the centerline of North Street, a distance of 1,198.87
feet; thence in a Southerly direction on a magnetic bearing of S 8° 44' 36" E a distance
of 35.00 feet to an Iron Pin and said Iron Pin being on the South right-of-way line of
North Street; thence continuing in a Southerly direction along a magnetic bearing of
S 8° 44' 36" E, a distance of 175 feet to the point of beginning, thence N 81 ° 15' 24" E
a distance of 90 feet; thence N 41 ° 15' 24" E, a distance of 60 feet which extends 15
feet :I: beyond the existing inlet; thence S 48° 44' 36" E a distance of 20 feet, thence
S 41 ° 15' 24" W a distance of 67.28 feet; thence S 81° 15'24" W a distance of 97.28
feet; thence N 8° 44' 36" W a distance of 20 feet to the point of beginning. The above
described parcel contains 3,145.65 square feet or 0.0722 acres more or less.
This easement also allows the of City of Salina, Kansas, to have an unimpeded use of
the exiting drainage system. The owners of said drainage system shall not plug or close
the drainage system in any way that would impede the flow of water
for all of the rights of ingress and egress of the said Party of the Second Part, its servants, officers,
employees and contractors for the purpose of the construction, installation, repairing, replacing and
maintaining a storm sewer pipeline, in perpetuity.
