THIS INDENTURE, made this ;?~ day of December, 1976, by
and between WILLIAM R. and ELLA L. UMPHREY, Parties of the First
Part and THE CITY OF SALINA, KANSAS, a municipal corporation,
Parties of the Second Part, WITNESSETH:
That the said Parties of the First Part for a good and
valuable consideration receipt and sufficiency of which is
hereby acknowledged, do by these presents grant, bargain, sell
and convey unto said Parties of the Second Part an easement in,
over and across a certain tracts of land owned by the Parties
of the First Part more particularly described as follows:
A twenty foot (201) utility easement along and ten
feet (101) either side of a line described as follows:
Beginning at the northwest corner of Lot Three (3),
Block Eight (8); thence south along the rear of Lots
One (1), Two (2) and Fifteen (15), and along the west
side of Lot Three (3) to the southwest corner of Lot
Three (3); thence southeasterly a distance of three
hundred thirty-three feet (3331) along the rear of
Lots Three (3), Four (4), Five (5), Six (6), Seven
(7), Fifteen (15), Sixteen (16), Seventeen (17),
Eighteen (18), Nineteen (19), Twenty (20), and the
west thirty-three feet (33') of Lot Eight (8), and
the west twenty-one feet (211) of Lot Twenty-one
(21), all in Key Acres Addition to the City of
Salina, Kansas.
An eight foot (81) utility easement described as
follows:
The southeast eight feet (81) of the northwest
twenty-one feet (211) of Lot Twenty-one (21),
Block Eight (8), all in Key Acres Addition to the
City of Salina, Kansas.
for all of the rights of ingress and egress of the said Parties of
the Second Part, its servants, officers, employees and contractors
for the purpose of the construction, installation, repairing,
replacing and maintaining water lines, sanitary sewer lines and
any other utilities as may be necessary in connection therewith,
in perpetuity.
IN WITNESS WHEREOF, the said Parties of the First Part have
hereunto set their hands, the day and year first above written.
