UTILITY EASEMENT
THIS INDENTURE, is made this .l../ ,4:% day of June, 2000, by and between JUMPIN'
JOE'S, LLC, Party of the First Part and THE CITY OF SALINA, KANSAS, a municipal
corporation, Party of the Second Part, WITNESSETH:
That the said Party of the First Part for a good and valuable consideration receipt and
sufficiency of which is hereby acknowledged, do by these presents, grant, bargain, sell and
convey unto said Party of the Second Part a 10' utility easement in, over and across a
certain parcel of land located in Lot 4, Block 1, Frank Industrial Area Addition to the City
of Salina, Saline County, Kansas, more particularly described as follows:
Commencing at the northeast corner of Lot 3 in said Block 1; thence east along the north
line of said Lot 3 extended, a distance of ten (10) feet to the east line of a platted twenty
(20) foot utility easement; thence north along said east line, a distance of forty (40) feet to
the point of beginning; thence continuing north along the east line of said easement, a
distance of fifty-five (55); thence east and parallel with the north line of said Lot 3, a
distance of ten (10) feet; thence south and parallel with the east line of said easement, a
distance of fifty-five (55) feet; thence west and parallel with the north line of said Lot 3, a
distance of ten (10) feet back to the point of beginning.
For all rights of ingress and egress of the said Party of the Second Part, its servants,
officers, employees, and contractors, for purposes of the construction, installation,
repairing, replacing and maintaining public utilities in perpetuity.
IN WITNESS WHEREOF, the said Party of the First Part have hereunto set their hands,
the day and year first above written.
