UTILITY EASEMENT
THIS INDENTURE, made the ~-~.~J~ay of September, 1995, by and
between LAVERN F. FORST & FRANCES M. FORST Parties of the First Part
and THE CITY OF SALINA, a municipal corporation, Parties of the Second
Part, witnesseth:
That the said Parties of the First Part for a good and valuable
consideration receipt of sufficiency of which is hereby acknowledged, do
by these presents, grant, bargain, sell and convey unto said Parties of
the Second part a utility easement in, over and across a certain tract of
land owned by the Parties of the First Part more particularly described as
f 011 ows :
A tract located in Lot 16, except the south 624 feet thereof, Garden Home
Addition, City of Salina, Kansas, being more particularly described as
f 011 ows :
Beginning at a point on the west right-of-way line of Ohio Street that is
262 feet north and 50 feet west of the southeast corner of the above
described tract; thence N90o00'W a distance of 15 feet; thence NOOoOO'E
parallel with said west right-of-way line a distance of 20 feet; thence
N90o00'E a distance of 15 feet to said west right-of-way line; thence
SOOoOO'E a distance of 20 feet to the point of beginning. Said tract
contains 300 square feet.
for all of the rights of ingress and egress of the said Parties of the
Second Pat, its servants, officers, employees and contractors for the
purpose of the construction, installation, repairing, replacing and
maintaining sanitary sewer facilities in perpetuity.
