CONVEYANCE OF EASEMENT
THIS INDENTURE, made this / ~ day of ~' 1957, by and
between Emma G. Simmons, a widow, of the first p , and the City
of Salina, Kansas, of the second part.
WHEREAS, party of the second part desires to obtain an easement
over, upon and through certain land owned by first party as herein-
after described.
WHEREAS, the party of the first part is the owner in fee simple
of said land and is willing to grant said second party said easement,
and
SO NOW, THEREFORE, Witnesseth:
That the party of the first part in consideration of the sum of
$1.00, and other good and valuable consideration, receipt of which
is hereby acknowledged, does by these presents, grant,. bargain, sell
and convey unto second party an easement in, over and across a
certain portion of land owned by first party, more particularly
described as follows:
Beginning at the southeast corner of Lot Seventeen
(17), Block One (1), Gebhart Manor Addition, to the City
of Salina, Saline County, Kansas, thence north five (5)
feet on the west line of Highland Avenue, thence west one
hundred eighty seven and four tenths (187.4) feet and
parallel to the south line of said Lot Seventeen (17),
thence south ten (10) feet on the east right of way line
of U.S. 81 Bypass, thence east one hundred eighty seven
and four tenths (187.4) feet and parallel to the south
line of said Lot Seventeen (17), thence north five (5)
feet to the point of beginning.
for all the rights of ingress and egress of second party, its servants,
officers, employees and contractors for the purpose of installing,
repairing, replàcing and maintaining any public utilities with con-
nections and appurtenances thereto in perpetuity, and running with
the land.
IN WITNESS WHEREOF, the party of the first part has set her
hand, all on the day and year first above written.
