MAINTENANCB BASEMENT
RELEASE AND INDEMNIFICATION
The Undersigned, Harry Junior Hoffman and Genevieve Hoffman,
husband and wife, (the "Grantor"), owner of record of the real
estate described at Saline County Register of Deeds Office Deed
Book 308, Page 31, hereby grants to the City of Salina, Kansas (the
"city") a maintenance easement, in perpetuity, over the North
Twenty-five feet (25') of the following described real estate:
A part of Tract Four (4) in Farm Subdivision of Thomas
White Farm, being a part of the Northwest Quarter (NW/4)
of Section Seven (7), Township Fourteen (14) South, Range
Two (2) West of the sixth Principal Meridian, in Saline
County, Kansas, described as follows:
Commencing at the Southeast ccrner of Lot Ten (10), Block
One (1), in Cloverdale, a subdivision in Saline County,
Kansas, thence West along the south line of said Lot Ten
(10) to the northeast corner of Prospect Avenue, said
point being due north of the northeast corner of Lot One
(1) in Cloverdale Annex, a subdivision of Saline County,
Kansas, thence South to the Northeast corner of said Lot
One (1) in Cloverdale Annex, thence South along the East
line of said Lot One (1) in Cloverdale Annex to the
Southeast corner of said Lot One (1); thence South along
a prolongation of said line to the North line of the
right-of-way of the Missouri Pacific Railroad, thence
Northeasterly along the northerly line of said right-of-
way to a point due south of the point of beginning,
thence north to the point of beginning.
for the purpose of accessing and maintaining the private drive that
continues east from the easternmost end of Prospect Avenue (the
"Private Drive") in such manner and at such times as the Director
of General services for the City determines appropriate.
In consideration for any maintenance work performed by the
City, Grantor hereby RELEASES, INDEMNIFIES and HOLDS HARMLESS the
City, its officers, and its employees from any claims and expenses
(including reasonable attorney fees) resulting from personal injury
or property damage arising from the performance of maintenance work
by the City within the maintenance easement granted herein.
Grantor further acknowledges awareness of and consents to the
posting of the Private Drive by the City with a sign which shall
state "minimum maintenance, travel at your own risk."
